Schedule 1—Exemption  2

1  Name

This instrument is the Greenhouse and Energy Minimum Standards (Exemption) Instrument (No. 1) 2019.

2  Commencement

This instrument commences the day after it is registered.

3  Authority

This instrument is made under subsection 37(1) of the Greenhouse and Energy Minimum Standards Act 2012.

4  Definitions

In this instrument:

Act means the Greenhouse and Energy Minimum Standards Act 2012.

determination means the Greenhouse and Energy Minimum Standards (Air Conditioners and Heat Pumps) Determination 2013.

exempt model: see section 5.

5  Exemption

The models specified in clause 1 of the Schedule (the exempt models) are exempt from the requirements of the Determination as described at clause 2 of the Schedule with respect to the supplies of the exempt models specified at clause 3 of the Schedule.

6  Conditions of exemption

There are no conditions specified for the purposes of subsection 37(2) of the Act.

Note:          Subsection 37(2) of the Act provides that the exemption may specify conditions to which the exemption is subject. Subsection 37(3) provides that a person must comply with a condition of an exemption to the extent that it applies to the person.

7  Repeal

This instrument is repealed on 1 January 2020.

Requirements of the Determination as follows:

GEMS level requirements The models are exempted from the requirements for conducting tests mentioned in section 6 of the determination

3  Supplies to which the exemption applies

This exemption only applies in relation to the supply of air conditioners with the specifications set out in clause 1 above.
