FRENCH CJ:   These appeals from the New South Wales Court of Criminal Appeal were heard in Canberra on 24 June 2011 by a Court constituted by Justices Heydon, Crennan, Kiefel, Bell and myself.  A majority of the Court is agreed that orders should be made in the terms I am about to pronounce.  The orders of the Court are, in each matter:

1.Appeal allowed.

2.Set aside the order of the Court of Criminal Appeal of New South Wales of 17 December 2010 and in its place order that the appeal to that court be dismissed.

I publish those orders.  The Court’s reasons will be delivered at a later date.
