Environmental Planning and Assessment Act 1979

1      Name of Plan

This Plan is Great Lakes Local Environmental Plan 1996 (Amendment

No 79).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to certain land at Carmona Lane and Sweet Pea Road, Forster South, at Failford Road, Failford and at Aquatic Road, Darawank, as shown edged heavy black and lettered “1 (d)”, “1 (d1)”, “2 (a)”, “4 (a)”, “5 (a)” and “7 (a1)” on the map marked “Great Lakes Local Environmental Plan 1996 (Amendment No 79)” deposited in the office of Great Lakes Council.

[1]      Clause 20 Land acquisition

Insert at the top of the Table to subclause (1), in the respective columns:

Zone No 5 (a) and lettered “Buffer to MidCoast Water

Sewerage Treatment Plant”

[2]      Clause 33 Additional land uses

Insert at the end of the Table to the clause, in the respective columns:

The part of Lot 45, DP 1126880 on the	Works for the purpose of stormwater
southern side of Sweet Pea Road, Forster	management.

South, as is within Zone No 7 (a1) and

shown hatched black on the map marked

Insert after clause 37:

38 Requirements for development of certain land

Development consent must not be granted for development on land described in Column 1 of Schedule 3 unless the Council is satisfied that all of the requirements specified opposite that land in Column 2 of Schedule 3 have been met.

Schedule 3—Special requirements for development on certain land

Column 1	Column 2
Lot 64, DP 753207, Failford	Arrangements, acceptable to the Council,
Road, Failford	have been made for:
(a) the protection and management, for conservation purposes, of that part of the land shown as “conservation area” in a development control plan that applies to the land, and (b) planting and ongoing management, of a wildlife movement corridor, in the location shown as “wildlife corridor” in a development

the establishment, including land.

Lots 1 and 2, DP 614397 and	Arrangements, acceptable to the Council,
Lot 45, DP1126880, Carmona	have been made for:
Lane and Sweet Pea Road, Forster	(a) the installation of water quality

treatment facilities that will

maintain or improve the quality of

stormwater discharged from the

development, and

(b)

the maintenance of those

facilities.

The part of Lot 45, DP 1126880

Arrangements, acceptable to the Council,

on the northern side of Sweet Pea

have been made that ensure that the

Road, Forster South zoned 4 (a)

development, except for development

General Industrial Zone

associated with an approved extractive

industry, will:

(a)

only be carried out on the parts of the land where the silica sand resource has been fully extracted, and

(b)

not compromise future extraction

of the silica sand resource.

within Zone No 7 (a1) (Environmental

Protection Zone).
