under the

Environmental Planning and Assessment Act 1979

1      Name of Plan

This Plan is Great Lakes Local Environmental Plan 1996 (Amendment

No 62).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Aims of Plan

The aims of this Plan are:

(a)

to rezone the land to which this Plan applies to Zone No 7 (a1) (Environmental Protection Zone) under Great Lakes Local Environmental Plan 1996, and

(b)

to allow, with the consent of Great Lakes Council, the use of certain land to which this Plan applies for the purposes of extractive industries.

4      Land to which Plan applies

This Plan applies to land in the following localities as shown edged heavy black and lettered “7 (a1)” on sheets 1–9 of the map marked “Great Lakes Local Environmental Plan 1996 (Amendment No 62)” deposited in the office of Great Lakes Council:

(a)

Darawank,

(b)

South Forster,

(c)

Forster,

(d)

Green Point,

(e)

North Tuncurry,

(f)

Wallis Lake,

(g)

Hawks Nest.

However, this Plan does not apply to land in the localities of Darawank and South Forster as shown hatched and edged heavy black on sheets 1–4 of that map and lettered “Deferred Matter”, being deferred matter within the meaning of section 68 (5) of the Environmental Planning and Assessment Act 1979 as in force immediately before 1 July 2009 (a provision which continues to apply to this Plan under clause 12 of the Environmental Planning and Assessment Regulation 2000).

5      Repeal of part of Manning Local Environmental Plan No 1

This Plan repeals Manning Local Environmental Plan No 1 to the extent that it applies to the land within the local government area of Great Lakes as shown edged broken black and lettered “7 (a1)” on sheets 1–9 of the map marked “Great Lakes Local Environmental Plan 1996 (Amendment No 62)” deposited in the office of Great Lakes Council.
