Great Barrier Reef Marine Park Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Great Barrier Reef Marine Park Act 1975.

1.   Commencement

1.1   These Regulations commence on 1 January 1997.

2.   Amendment

2.1   The Great Barrier Reef Marine Park Regulations are amended as set out in these Regulations.

3.   Regulation 34 (Interpretation)

3.1   Subregulation 34 (1) (definition of “beach equipment”, paragraph (d)):

Omit the paragraph, substitute:

  • “(d)

    pedal craft;”.

3.2   Subregulation 34 (1) (definition of “preceding quarter”):

Omit the definition.

3.3   Insert:

‘quarter’ means a period of 3 months beginning on 1 January, 1 April, 1 July or 1 October;”.

4.  Regulation 37 (Standard tourist program charge)

4.1   Subregulation 37 (1):

Omit “$1.00”, substitute “$2.00”.

5.   Regulation 41 (Semi-submersible and glass-bottomed boats charges)

5.1   Subregulation 41 (1):

Omit “N ´ 0.2 ´ $1.00”, substitute “N ´ 0.2 ´ $2.00”.

6.   Regulation 42 (Sight-seeing aircraft charges)

6.1   Subregulation 42 (1):

Omit “N ´ 0.2 ´ $1.00”, substitute “N ´ 0.2 ´ $2.00”.

7.   Regulation 43 (Pontoon charges)

7.1   Paragraph 43 (1) (a):

Omit “$45.00”, substitute “$90.00”.

7.2   Paragraph 43 (1) (b):

Omit the paragraph, substitute:

  • “(b)

    if the horizontal surface area of the pontoon is more than 40 square metres—the greater of:

    • (i)

      $180.00 for the quarter; or

    • (ii)

      $2.00 for each visitor for each excursion to the pontoon that the visitor is taken on by the holder.”.

8.   Regulation 44 (Floating hotel charges)

8.1   Subregulation 44 (1):

Omit the subregulation, substitute:

 “44.(1) The charge payable by the holder of a permission for the operation of a floating hotel is the greater of:

  • (a)

    $280.00 for the quarter; or

  • (b)

    $2.00 for each visitor for each night in the quarter that he or she is accommodated in the hotel.”.

9.   Regulation 45 (Marina charges)

9.1   Subregulation 45 (1):

Omit “$190.00”, substitute “$380.00”.

9.2   Subregulation 45 (1A):

Omit the subregulation, substitute:

 “(1A) The charge payable by the holder of a permission for the operation of a marina is the greater of:

  • (a)

    $380.00 for the quarter; or

  • (b)

    $2.00 for each visiting vessel (except a vessel operated by the permission holder) that is berthed at the marina for each night in the quarter that it is berthed.”.

10.   Regulation 46 (Underwater observatory charges)

10.1   Paragraph 46 (1) (a):

Omit “$65.00”, substitute “$130.00”.

10.2   Paragraph 46 (1) (b):

Omit “N ´ 0.1 ´ $1.00”, substitute “N ´ 0.1 ´ $2.00”.

11.   Regulation 47 (Lady Elliott Island charges)

11.1   Subregulation 47 (1):

Omit “$1.00”, substitute “$2.00”.

12.   Regulation 48 (Discharge of sewage charges)

12.1   Paragraph 48 (1) (a):

Omit “$200.00”, substitute “$400.00”.

12.2  Subparagraph 48 (1) (b) (i):

Omit “$200.00”, substitute “$400.00”.

12.3   Subparagraph 48 (1) (b) (ii):

Omit “$1.9 ´ V ´ (N+ P)”, substitute “$4.00 ´ V ´ (N + P)”.

13.   Regulation 49 (Vessel chartering charges)

13.1   Subregulation 49 (1):

Omit “$1.00”, substitute “$2.00”.

14.   Regulation 50 (Vending operations charges)

14.1   Subregulation 50 (1):

Omit the subregulation, substitute:

 “50. (1)The charge payable by the holder of a permission for the sale of goods or services from a vessel is $30.00 for a quarter for each metre of the overall length of the vessel, unless:

  • (a)

    the sale of goods and services is carried on primarily during an operation in respect of which a charge applies under regulation 37, 43, 44, 45, 46 or 49; or

  • (b)

    the vessel is used primarily for the provision of goods or services to commercial fishing vessels.”.

15.   Regulation 51 (Mariculture)

15.1   Paragraph 51 (1) (a):

Omit “$250.00”, substitute “$500.00”.

15.2   Paragraph 51 (1) (b):

Omit “$100.00”, substitute “$200.00”.

16.   Regulation 53 (Returns)

16.1   Subregulation 53 (1):

Omit the subregulation, substitute:

 “53.(1)A permission holder referred to in this Part (except the holder of a permission referred to in regulation 48) must give the Authority, in each April, July, October and January, in relation to the preceding quarter:

  • (a)

    a charge return, in a form approved by the Authority; and

  • (b)

    a copy of the part of the logbook supplied to the holder by the Authority, or the form approved by the Authority, for the recording of the information.”.
