Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Great Barrier Reef Marine Park Act 1975.

Commencement

1. These Regulations shall come into operation on 1 February 1986.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Great Barrier Reef Marine Park Regulations.

Interpretation

3. Regulation 4 of the Principal Regulations is amended—

(a) by inserting after the definition of “Cormorant Pass Section” in sub-regulation (1) the following definition:

“ ‘Far Northern Section’ means the area declared to be a part of the Great Barrier Reef Marine Park by Proclamation made under sub-section 31 (1) of the Act and published in the Gazette on 31 August 1983 and assigned by that Proclamation the name “Great Barrier Reef Marine Park—Far Northern Section”;”; and

(b) by omitting “or the Cormorant Pass Section” from the definition of “zone” in sub-regulation (1) and substituting “, the Cormorant Pass Section or the Far Northern Section”.

Provisions giving effect to certain provisions contained in a zoning plan

4. Regulation 6 of the Principal Regulations is amended—

(a) by omitting from sub-regulation (2) “Part” and substituting “Schedule”;

(b) by inserting after sub-regulation (2) the following sub-regulations:

“(2a) For the purposes of the definition of ‘amateur net’ contained in a zoning plan, each net described in serial numbers 1, 2, 3, 4 and 5 in Column 3 of the Sixth Schedule to the Fisheries Regulations 1977 of the State of Queensland, as in force on 1 February 1986, is declared.

“(2b) A word or expression that is used in a provision of the Fisheries Regulations 1977 of the State of Queensland, as in force on 1 February 1986, specified in sub-regulation (2a) and is defined for the purposes of those regulations shall, for the purposes of the definition of ‘amateur net’ in a zoning plan, have the same meaning as it has in those regulations, except that where the same word or expression is defined for the purposes of that zoning plan, that word or expression shall, for the purposes of the definition of ‘amateur net’ have the same meaning as it has in that zoning plan.”; and

(c) by adding at the end the following sub-regulation:

“(5) For the purposes of the definition of ‘drop purse seine net’ contained in a zoning plan, a purse seine net of not more than 200 metres in length is declared.”.

Offences relating to use of zones

5. Regulation 13 of the Principal Regulations is amended by omitting from sub-regulation (2c) “sub-regulation 10 (3)” and substituting “sub-regulation 10 (2)”.

Schedule 1

6. Schedule 1 to the Principal Regulations is amended—

(a) by omitting from Part 1 —

“Genus Lienardella”

and substituting—

“Genus Choerodon”;

(b) by inserting in that Part—

“Family Nautilidae”

after—

“Class Bivalvia (except Family Amusiidae)”; and

(c) by omitting from that Part—

“Order Mysticeli

Order Odontoceti”

and substituting—

“Sub-order Mysticeti

Sub-order Odontoceti”.

 

Schedule 1a

7. Schedule 1a to the Principal Regulations is amended—

(a) by omitting—

“Genus Lienardella”

and substituting—

“Genus Choerodon”;

(b) by inserting—

“Family Nautilidae”

after—

“Class Bivalvia (except Family Amusiidae)”; and

(c) by omitting—

“Order Mysliceti

Order Odontoceti”

and substituting—

“Sub-order Mysticeti

Sub-order Odontoceti”.
