Great Barrier Reef Marine Park Regulations 2(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Great Barrier Reef Marine Park Act 1975.

1.   Commencement

1.1   These Regulations commence on 3 April 1992.

2.   Amendment

2.1   The Great Barrier Reef Marine Park Regulations are amended as set out in these Regulations.

3.   Regulation 4 (Interpretation)

3.1   Subregulation 4 (1) (definition of “Cairns Section”):

Omit the definition, substitute:

‘Cairns Section’ means the area assigned the name ‘Great Barrier Reef Marine Park—Cairns Section’ by the Proclamation made under subsection 31 (1) of the Act and published in the Gazette on 13 September 1989;”.

3.2   Subregulation 4 (1) (definition of “Cormorant Pass Section”):

Omit the definition.

3.3   Subregulation 4 (1) (definition of “zone”)

Omit “the Cormorant Pass Section,”.

4.   Heading of Part II (ZONES (CAIRNS SECTION, CORMORANT PASS SECTION AND FAR NORTHERN SECTION))

4.1   Omit the heading, substitute:

“PART 2—ZONES (FAR NORTHERN SECTION)”.

5.   Regulation 6a (Interpretation)

5.1   Definition of “zone”:

Omit “the Cairns Section, the Cormorant Pass Section or”.

6.   Heading of Part IIa (PART IIa—ZONES (CENTRAL SECTION AND MACKAY/CAPRICORN SECTION))

6.1   Omit the heading, substitute:

“PART 2A—ZONES (CAIRNS SECTION, CENTRAL SECTION AND MACKAY/CAPRICORN SECTION)”.

7.   Regulation 13aa (Interpretation)

7.1   Definition of “zone”:

Omit the definition, substitute:

‘zone’ means a zone into which the Cairns Section, the Central Section or the Mackay/Capricorn Section has been divided by a zoning plan.”.

8.   Regulation 13ab (Zoning plan definitions - collecting, fishing, netting and crabbing)

8.1   Subregulations 13ab (1) to (9) (inclusive):

Omit “the zoning plan” (wherever occurring), substitute “a zoning plan”.

8.2   Paragraph 13ab (2) (b):

After “species”, insert “(except a species listed in Schedule 1c)”.

8.3   Subregulation 13ab (2):

Add at the end:

  • “; (c)

    an invertebrate in a species listed in Schedule 1c is not to be collected with the aid of any underwater breathing apparatus except a snorkel.”.

8.4   Subregulation 13ab (3):

Omit the subregulation, substitute:

“(3)

For the purposes of the definition of ‘fishing’ contained in a zoning plan, a declared fish, crustacean or mollusc is a fish, crustacean or mollusc that is not in a taxon specified in Schedule 1d.

 “(3a) Trawl equipment is stowed or secured within the meaning of the zoning plan for the Cairns Section if it is rendered inoperative at least to the extent that the nets:

(a)

are out of the water; and

(b)

are hung on board; and

(c)

have the cod ends open.”.

8.5   Subregulation 13ab (6):

Omit “numbers 24 and”, substitute “number”.

8.6   Subregulation 13ab (6):

Omit “numbers 4 and”, substitute “number”.

8.7   Paragraph 13ab (6) (d):

Omit the paragraph.

8.8   Subregulation 13ab (7):

Omit “numbers 4 and 5 in Column 3 of Part A”, substitute “number 5 in Column 3”.

9.   Regulation 13ac (Use of, or entry into, a zone with permission)

9.1   Paragraphs 13ac (4) (a) and (c) to (g) (inclusive):

Add at the end “and”.

9.2   Paragraph 13ac (4) (b):

Omit the paragraph, substitute:

  • “(b)

    the need to protect the cultural and heritage values held in relation to the Marine Park by traditional inhabitants and other people; and”.

9.3   Subregulation 13ac (4):

Add at the end:

 “; and

  • (j)

    any other requirements for ensuring the orderly and proper management of the Marine Park.”.

10.   Regulation 13c (Consideration of application—unzoned area)

10.1   Paragraph 13c (a):

Omit the paragraph, substitute:

  • “(a)

    the need to protect the cultural and heritage values held in relation to the Marine Park by traditional inhabitants and other people; and”.

10.2   Paragraphs 13c (b) to (h) (inclusive):

Add at the end “and”.

10.3   Regulation 13c:

Add at the end:

 “; and

  • (l)

    any other requirements for ensuring the orderly and proper management of the Marine Park.”.

11.   Regulation 13g (Removal of property)

11.1   Subregulation 13g (3) (definition of “prescribed person”):

Add at the end:

 “; or

  • (c)

    the person who controls or possesses the property.”.

11.2   Subregulation 13g (3) (definition of “prescribed property”):

Omit “constructed or fixed in position”, substitute “constructed, fixed in position or brought into the Marine Park”.

12.   Schedule 1 (Animals, plants and marine products)

12.1   Part I:

After “Phylum Porifera”, insert “Phylum Annelida”.

12.2   Part I:

Omit “(except Family Palinuridae, Family Penaeidae, Family Scyllaridae, species Portunus sanguinolentus, males of the species Portunus pelagicus or Scylla serrata)”.

12.3   Part I:

Omit “(except Family Amusiidae)”.

13.   Schedule 1b (Animals, plants and marine products)

13.1   Part I:

Omit “(except Class Polychaeta)”.

13.2   Part I:

Omit “(except Family Palinuridae, Family Penaeidae, Family Scyllaridae, Section Brachyura, Genus Upogebia, Genus Callianassa)”.

13.3   Part I:

Omit “(except Family Amusiidae, Family Ostreidae, species Plebidonax deltoides)”.

14.   New Schedules 1c and 1d

14.1   After Schedule 1b, insert:

15.   Savings—previous permission

15.1   Subject to subregulation 15.2, a relevant permission granted in relation to the Cairns Section or the Cormorant Pass Section that was in force immediately before the commencement of these Regulations continues in force on and after their commencement as if it had been granted in relation to the Cairns Section under the Principal Regulations as amended by these Regulations.

15.2   A permission continued in force under subregulation 15.1 does not allow the holder of the permission to carry out an activity in an area where he or she was not permitted to carry out the activity under the Principal Regulations and the zoning plan that came into force on 7 November 1983 for the Cairns Section.

15.3   In this regulation:

“Principal Regulations” mean the Great Barrier Reef Marine Park Regulations as in force immediately before the commencement of these Regulations;

“relevant permission” means a relevant permission granted under regulation 11 of the Principal Regulations.
