No. VII.

An Act to prohibit the Importation of Grape­

vines Grape-vine-cuttings and Grapes.

[16th November, 1881.]

b y the Queen's Mos t Excel lent Majesty b y and with the advice and WH E R E A S it is desirable to prevent the introduction of the disease known as Phyl loxera vastatrix Be it therefore enacted

consent of the Legislative Counci l and Legislative Assembly of N e w South Wales in Parliament assembled and b y the authority of the same as fol lows : —

1. I t shall not be lawful to import into the Colony either b y sea

or land any Grape-vines Grape-vine-cuttings or Grapes and whosoever
shall so import or attempt to import any such Vines Vine-cutt ings or Grapes shall forfeit arid pay for every such offence any sum not exceeding twenty pounds and all such Vines Vine-cutt ings or Grapes imported or attempted to be imported contrary to the provisions of this section shall be forfeited and may be seized and destroyed b y any officer o f Customs or pol ice officer Provided that it shall be lawful for the Governor with the advice of the Execut ive Council b y proclamation in the Government Gazette to exempt any place or places from the operation of this A c t .

2. Nothing herein contained shall apply to raisins or currants. 3. W h o s o e v e r shall wilfully obstruct any officer of Customs

pol ice officer or constable when acting in the execution of this A c t shall forfeit and pay for every such offence any sum not exceeding ten pounds.
4. A l l information for offences against this A c t may be heard and determined and all penalties under this A c t may be imposed b y any two Justices of the Peace in a summary way.
5. This A c t shall continue in force until the first day of January one thousand eight hundred and eighty-six and may be cited as the

" Grape-vines and Grapes Importat ion Prohibit ion A c t . "
