An Act to prohibit the Importat ion of Grape­

vines Grape-vine-cutt ings and Grapes. [23rd

it is desirable to p reven t t h e in t roduc t ion of the
disease k n o w n as Oid ium Be i t therefore enacted by the

of t h e Legislat ive Council and Legislat ive Assembly of N e w South Wales in Pa r l i amen t assembled and by t h e au tho r i t y of t h e same as fo l lows:—

1. I t shall no t be lawful to impor t in to t he Colony e i ther by sea or l and any Grape-vines Grape-vine-cut t ings or Grapes a n d who­ soever shal l so impor t or a t t emp t to impor t any such Vines Vine- cu t t ings or Grapes shal l forfeit a n d pay any s u m n o t exceeding twen ty pounds and all such Vines Vine-cu t t ings or Grapes impor ted or a t t emp ted to be impor ted con t ra ry to t he provisions of th i s section shall be forfeited and m a y be seized and destroyed by any officer of Customs or police officer Provided t h a t it shall be lawful for t he Governor

w i th t h e advice of t he Execu t ive Counci l by proclamat ion in t h e
Government Gazette to exempt any place or places from t h e operation
of th i s Ac t .
2. N o t h i n g here in conta ined shall apply to raisins or cur ran t s .
3 . Whosoever shall wilfully obs t ruc t any officer of Customs
police officer or constable w h e n ac t ing in t h e execut ion of th i s Ac t

shall forfeit and pay any sum no t exceeding t en pounds .
4. Al l informations for offences agains t th is Ac t m a y be heard and determined and al l penal t ies u n d e r th is A c t m a y be imposed by any two Jus t i ces of t he Peace in a s u m m a r y way and m a y be recovered b y distress and sale of t h e offender's goods Provided however t h a t

every such informat ion shall be laid wi th in two m o n t h s after t he
commission of t he said offence.
5. One moie ty of any pena l ty imposed under t h e provisions of

th i s A c t shal l go to t he informer a n d the o ther moie ty to t h e Colonial Treasurer to be by h im carr ied over to t h e Consolidated R e v e n u e F u n d .

6. This A c t shall come in to operat ion on t h e first day of J a n u a r y one thousand e ight h u n d r e d and s ixty-eight a n d shal l cont inue

in force un t i l t h e first day of J a n u a r y one thousand eight h u n d r e d and seventy a n d m a y be cited as t he " Grape-vines and Grapes
