Queensland Grain Industry (Restructuring) Amendment Act 1993 Act No. 40 of 1993 An Act to amend the Grain Industry (Restructuring) Act 1991 [Assented to 7 September 1993]

4 Grain Industry (Restructuring) Amendment No. 40, 1993 The Parliament of Queensland enacts— ˙ Short title 1. This Act may be cited as the Grain Industry (Restructuring) Amendment Act 1993 . ˙ Amended Act 2. The Grain Industry (Restructuring) Act 1991 is amended as set out in this Act. ˙ Amendment of s.2 (Objects of Act) 3.(1) Section 2(g)— omit. (2) Section 2(h) and (i)— renumber as section 2(g) and (h). ˙ Omission of Part 5 (ss.54–9) 4. Part 5— omit. ˙ Replacement of s.91 (Regulations) 5. Section 91— omit, insert— ˙ ‘Regulations ‘91. The Governor in Council may make regulations for the purposes of this Act. ’.

5 Grain Industry (Restructuring) Amendment No. 40, 1993 ˙ Amendment of Schedule 1 (Repeals and Transitional Provision) 6.(1) Schedule 1, clause 3(4)— omit. (2) Schedule 1— insert— ˙ ‘Winding-up of former hail compensation schemes ‘4.(1) The Hail Compensation (Wheat) Fund and the Hail Compensation (Barley) Fund are terminated and any amount standing to the credit of the Funds at the termination date vests absolutely in Grainco. ‘(2) The hail compensation schemes maintained by Grainco under Part 5 before the termination date are abolished. ‘(3) However— (a) any right to compensation ( “accrued compensation” ) that had accrued under section 58 before the termination date may be enforced against Grainco; and (b) any accrued compensation payable by Grainco after the termination date is to be paid out of Grainco’s general funds. ‘(4) In this section— “termination date” means the day on which the Grain Industry (Restructuring) Amendment Act 1993 commences. ’.
