DISMISSAL OF APPLICATION FOR REVIEW:

  1. The Tribunal is satisfied that Mr Goyle was given appropriate notice of the time and place of the hearing which was listed to be held on 9 May 2018.

  2. Mr Goyle failed to appear at that hearing. 

  3. Pursuant to subsection 42A(2) of the Administrative Appeals Tribunal Act 1975, the Tribunal dismisses the application for review. 

  4. The reasons for this decision are set out in the following paragraphs.

  5. Mr Goyle was notified of the details of the hearing by letter dated 23 April 2018. An SMS reminder was sent to the mobile telephone number provided by Mr Goyle the day before the hearing. It included details of the time and date of the hearing. Mr Goyle did not contact before or after the hearing to advise that he was unable to attend. In the circumstances the tribunal decided to dismiss the application for review.
