I, Graeme Head, Public Service Commissioner, in pursuance of the Government Sector
Employment Act 2013, make the following Rule.

1 Name of Instrument
This Rule is the Government Sector Employment Rules (Amendment No 8—Agency
Heads) 2017.
2 Commencement
This Rule commences on the day on which it is published on the NSW legislation website.

Rule 53
Omit the rule. Insert instead:
53 Appointment of heads of Public Service agencies (other than Secretaries of Departments)
(1) In this rule:
agency head means:
(a) the head of a Public Service executive agency, or (b) the head of a separate Public Service agency whose office is established by section 28 of the Act. existing Public Service head means a person who is the Secretary of a Department or an agency head or who was the Secretary of a Department or an agency head within the previous 3 months.
existing senior executive means a person who is a Public Service senior executive or who was a Public Service senior executive within the previous 3 months.
Public Service senior executive includes a senior executive in the HealthService, the Transport Service or the NSW Police Force.
(2) Part 3 does not apply to the appointment of a person as an agency head (and
subrule (3) applies instead):
(a) if the person is being re-appointed as the agency head, or (b) if the person is an existing Public Service head, or (c) if the person is an existing senior executive who is being employed in the same band as the band in which the person was employed as an existing senior executive. (3) Any such appointment of a person as agency head may be made if the person making the appointment is satisfied that the person is suitable for appointment to the office concerned.
