1      Name of Rule

This Rule is the Government Sector Employment (General) Rules (Amendment No

11—COVID-19) 2020.

2      Commencement

This Rule commences on the day on which it is published on the NSW legislation website.

3 Amendment of Government Sector Employment (General) Rules 2014

(1) Rule 15

Omit the rule. Insert instead—

15      Application of Part

(1) Except as provided by these Rules and subrule (2), this Part applies to
employment in the Public Service.

(2)

This Part does not apply to the decision to employ a person under the Act in temporary or term employment for a period of up to 2 years if—

(a)

the purpose of the employment is to provide assistance in response, or is otherwise related, to the COVID-19 pandemic, and

(b)

on the basis of an assessment of the person’s capabilities, experience and knowledge, the agency head is satisfied that the person is suitable for the role to which the person is to be assigned and for the needs of the Public Service agency.

(2) Rule 21 Temporary or term employment for up to 12 months
Insert after subrule (2A)—
(2B) Subrule (2) does not apply if—
(a) the continuation of the person’s employment is for a period of up to 2 years and is for the purposes of providing assistance in response, or is otherwise related, to the COVID-19 pandemic, or
(b) the continuation of the person’s employment commences within the period of 12 months immediately following the commencement of this subrule and is for a period of up to 12 months.
