AN ACT to amend the Government School Teachers

Arbitration and Appeal Act 1979.

[Assented to 4 December 1981.1

BE it enacted by the Queen's Most Excellent1-1 Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

1. (1) This Act may be cited as the Government a,,,reigtl.1

School Teachers Arbitration and Appeal Amend-

ment Act 1981.

In this Act the Government School Teachers :rt .:4 65

Arbitration and Appeal Act 1979 is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Government School Teachers Arbitration and Appeal Act 1979-1981.

Section 10

amended.

2. Section 10 of the principal Act is amended by repealing subsection (2) and substituting the following subsection-

({ (2) A person so appointed has all the func- tions, powers and duties of the member for whom he is the deputy in the event of

(a)

that member being unable to attend to his duties under this Act, whether on account of illness or otherwise; or

(b)

the office of that member being vacant. " .

Section 23

amended.

3. Section 23 of the principal Act is amended

(a)

by inserting after the section designation "23." the subsection designation "(1)"; and

(b) by inserting the following subsection

t< (2) Where the Tribunal, in deciding

any matter before it under this Part, proposes or intends to take into account any matter or information that was not raised before it on the hearing of the matter, the Tribunal shall, before determining the matter, notify the parties concerned and afford them the opportunity of being heard in relation to that matter or information. " .

Section 29

amended.

4. Section 29 of the principal Act is amended by inserting after subsection (2) the following sub- section

(3) Without limiting the generality of sub- section (1) the Tribunal may confirm, modify or reverse any decision, determination or finding appealed against. " •
