Act N o . 54 , 1980 .

An Act to amend the Government Railways Act, 1912, so as to increase certain superannuation allowances and pensions payable under that Act. [Assented to, 28th April, 1980.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the "Government Railways

(Superannuation) Amendment Act, 1980".

2.       (1) Except as provided in subsection ( 2 ) , this Act shall

commence on the date of assent to this Act.

(2) Section 3 and Schedule 1 shall be deemed to have

commenced on 19th September, 1979.

3.      The Government Railways Act, 1912, is amended in the

manner set forth in Schedule 1.

SCHEDULE 1.

(1) Section 114BA—

After section 114B, insert :—

114BA. (1) Where any superannuation allowance

calculated in accordance with the provisions of this Part is at the commencement of this section payable to, or after

that commencement becomes payable to, any officer under this Part, the allowance shall, as from that commencement or as from the date upon which the officer becomes entitled to the allowance, as the case may be, be increased by one- eighth.

(2) This section—

(a) shall take effect on and from 19th September, 1979; and

(b) has effect subject to sections 123 and 123A.

(2) (a) Section 114D ( 1 ) —

After "114B", insert ", 114BA".

(b) Section 1 14D (2) —

After "equal", insert "1121 per cent of the product of".

(3) (a) Section 121B (1) —

After "review year", insert "commencing on or after

1st July, 1979".

(b) Section 121B ( 2 ) —

Omit "those", insert instead "112 i per cent of the amounts".

(4) Fourth S c h e d u l e -

Omit the matter appearing under the heading "Maximum

Pension Rate per annum", insert instead :—
