GOVERNMENT RAILWAYS AND TRANSPORT

(AMENDMENT) ACT.

Act No. 10, 1963.

An Act to make certain: provisions with respect to officers of the Departments of Railways, Government Transport and Motor Transport; for these purposes to amend the Government Railways Act, 1912-1962, and the Transport Act, 1930-1962; and for purposes connected therewith. [Assented

to, 29th March, 1963.]

D E it enacted by the Queen's Most Excellent Majesty, by
and with the advice and consent of the Legislative
Council and Legislative Assembly of New South Wales in

Act, 1930-1963.

Parliament assembled, and by the authority of the same, as

follows: —

(1) This Act may be cited as the "Government Rail- ways and Transport (Amendment) Act, 1963".

(2) The Government Railways Act, 1912, as amended by subsequent Acts and by this Act, may be cited as the Government. Railways Act, L912rl.963.

(3) The Transport Act, 1930, as amended by sub-
sequent Acts and by this Act, may be cited as the Transport

2.      The Government Railways Act, 1912, as amended by

subsequent Acts, is amended—

(a)

by omitting from section eighty-six the words "two thousand five hundred pounds" and by inserting in lieu thereof the words "two thousand nine hundred pounds";

(b)

(i)	by inserting in subsection six of section 100A after the words "subsection two" the word and symbols "or (2A)" ;
(ii)	by inserting at the end of subsection seven of the same section the following new para­ graph :—

For the purposes of subsections two and

(2A) of this section "service" includes any

period of leave without pay not exceeding six

months.

(c) by omitting from subsection three of section 100B the figures "1926-1942" and by inserting in lieu thereof the figures and words "1926, as amended by subsequent Acts".

3. The Transport Act, 1930, as amended by subsequent

Acts, is amended—

(a) by omitting from section one hundred and thirteen the words "two thousand five hundred pounds" and by inserting in lieu thereof the words "two thousand nine hundred pounds";

(b) (i) by inserting in subsection six of section one	hundred and twenty-three after the words "subsection two" the word and symbols "or
( 2 A ) " ;
(ii)	by inserting at the end of subsection seven of the same section the following new paragraph : —

For the purposes of subsections two and

(2A) of this section "service" includes any

period of leave without pay not exceeding six

months.

(c)

(c) by omitting from, subsection three of section one hundred and twenty-four the figures "1926-1942" , and by inserting in lieu thereof the figures and words "1926, as amended by subsequent Acts?'; :

(d) (i) by omitting from section 132A the word

"total" wherever occurring;

(ii)   by inserting next after subsection five of the same section the following new subsection : —

(5A) Where a person has been paid a gratuity under the provisions of this section or any sum in the nature of a gratuity for service as an officer and such person there- after again becomes an officer, there shall for the purpose of calculating the number of weeks' salary or wages payable as further gratuity be excluded the number of weeks in respect- of. which such gratuity or sum in the nature of gratuity previously paid was calculated.
