GOVERNMENT RAILWAYS AND
MAIN ROADS (AMENDMENT)
ACT.
Act No. 61, 1931.
An Act to vest the powers, authorities, duties, and functions of the Railway Commissioners for New South Wales in the Chief Railway Commissioner for New South Wales; to make further provision for the execution of the Main Roads Act, 1924-1929, as amended
by subsequent Acts; to amend the Govern
ment Railways Acts, 1912-1930, and certain other Acts; and for purposes connected therewith. [Assented to, 7th December,1931.]
BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with the advice and consent of the Legis Wales in Parliament assembled, and by the authority of the same, as follows :—
1 . (1) This Act may be cited as the "Government Railways and Main Roads (Amendment)
Act, 1 9 3 1 . "
(2) The Government Railways Acts, 19] 2 -1930 ,
as amended by this Act, may be cited as the Govern
ment Railwav's Act, 1 9 1 2 - 1 9 3 1 .
2 . (1) On and from the first day of January, one thousand nine hundred and thirty-two, the powers, authorities, duties, and functions of the Railway Com missioners for New South Wales shall be exercised and performed by the Chief Railway Commissioner for New South Wales.

(2) The offices of the Assistant Railway Com missioners for New South Wales shall be deemed to have been abolished for the purposes of section one hundred and thirteen of the Government Railways Act,
1912 -1931 .
(3) I n the case of the illness, suspension, or
absence of the said Chief Commissioner the Governor
may appoint as deputy of the said Chief Commissioner some officer of the Railway Commissioners for New South Wales who shall during such illness, suspension,
or absence of the said Chief Commissioner exercise his
powers and authorities and perform his duties and
functions.
(4) Section one hundred and ten of the Govern ment Railways Acts, 1912-1930, is amended by omitting the words " an Assistant Commissioner" and by inserting in lieu thereof the words " an offieer of the
Railway Commissioners for New South Wales."
(1) On and from the seventh day of January, one thousand nine hundred and thirty-tw ro, Hugh Hamilton Newell, Esquire, shall be deemed to have been appointed President of the Main Roads Board of New South

Wales, but shall hold office as such only until the
thirty-first day of December, one thousand nine hundred and thirty-two, or until such earlier date as may be provided in any Act.
(2) On and from the eighteenth day of March, one thousand nine hundred and thirty-two, Thomas Haynes Upton, Esquire, shall be deemed to hsuve been appointed a member of the said Board, but shall hold

| (3) On and from the seventh day of January, one thousand nine hundred and thirtv-tw^o, the said Hugh Hamilton Newell, Esquire, and tike sand Thomas Haynes Upton, Esquire, or any person appointed by the Governor in either of their places in ease of death, suspension, removal, absence, or illness, shall con stitute the Main Roads Board of Newr South Wales until the said thirtv-first dav of December, one thousand nine hundred and thirtv-two, or until such earlier date | ||

(4) During' the period referred to in subsection three of this section the following provisions shall have effect:—
(a) If at any meeting of the Board the members differ in opinion upon any matter, the Presi- dent shall have a casting as well as a delibera- tive vote and the matter shall be determined accordingly. (b) The President may, in the absence of another member, exercise and perform any power, authority, function, or duty which is vested in or imposed upon the Board.
