AN ACT to amend the Government Railways

Act, 1904-1953.

[Assented to 14th September, 1954.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

and citation.

1. (1) This Act may be cited as the Government

Railways Act Amendment Act, 1954.

(2) In this Act the Government Railways Act,

1904-1953,

to and including No. 78 of 1948, incorporated pursuant to the Amendments Incorporation Act, 1938, and as further amended by Acts Nos. 32 of 1951 and 86 of 1953,

is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Government Railways Act, 1904-1954.

2.   Paragraph (c) of subsection (1) of section laded.

seventy-eight of the principal Act is amended by substituting for the second, third and fourth para- graphs of paragraph (c) the following:

One person, his deputy and his substitute to be elected in the prescribed manner from the wages staff of the Secretary's Branch, Industrial and Staff Branch, Accounts and Audit Branch, Traffic Branch, excluding employees of the Motive Power Sect i o n, and other wages employees not specified.

One person, his deputy and his substitute to be elected in the prescribed manner from the wages staff of the Motive Power Section of the Traffic Branch, excluding tradesmen and their assistants employed in that branch.

One person, his deputy and his substitute to be elected in the prescribed manner from the wages staff of the Mechanical and Stores Branch and tradesmen and their assistants employed in the Traffic Branch.

3.    Section seventy-nine of the principal Act is

amended by

(a)

adding after the word "thereafter" in the last line of subsection (1) the words "but on and after the coming into operation of the Government Railways Act Amendment Act, 1954, a ballot shall be so taken on a pre- scribed day in the month of October, one thousand nine hundred and fifty-six, in lieu of the first Monday in February of that year and on the prescribed day in the month of October in every three years thereafter";

(b)

substituting for the words "the end of the next succeeding term of three years" in lines four and five of the proviso to subsec- tion (2) the words "the next succeeding ordinary election is held";

(c)

adding after the word "taken" in line one of subsection (3) the words "on the day and";

(d)

deleting the word "locomotive," in the last line of the proviso to subsection (5);

(e) adding a subsection as follows:

(6) Notwithstanding the provisions of subsection (1) of this section the persons elected to be members of the Appeal Board at the ordinary election held in February, one thousand nine hundred and fifty-three, are deemed to have been elected to be members of the Board until the next ordinary election is held on the prescribed day in October, one thousand nine hundred and fifty-six.
