An Act to amend the Government Procurement Act 2001

The Legislative Assembly for the Australian Capital Territory enacts as follows:

  1. Name of Act

    This Act is the Government Procurement Amendment Act 2005.

  2. Commencement

    This Act commences on the day after its notification day.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This Act amends the Government Procurement Act 2001.

  4. Grounds for confidentiality of information
    New section 35 (1) (a) (v) and (vi)

    insert

    (v)disclose information that may put public safety or the security of the Territory at risk; or

    (vi)disclose information prescribed by regulation for this section; or

  5. Section 35 (1), examples for par (a)

    substitute

    Example for par (a) (ii)

    intellectual property including software source codes

    information on the design and operation of goods

    1     hourly rates, on-costs and management fees
