Government Prices Oversight (MAIB Premiums) Amendment Order 2000

I make the following order under section 36 of the Government Prices Oversight Act 1995 .13 June 2000

1Short titleThis order may be cited as the Government Prices Oversight (MAIB Premiums) Amendment Order 2000 . 2CommencementThis order takes effect immediately after the Passenger Transport Act 1997 commences. 3Principal OrderIn this order, the Government Prices Oversight (MAIB Premiums) Order 1997 is referred to as the Principal Order. 4Clause 3 amended (Interpretation) Clause 3(1) of the Principal Order is amended as follows: (a) by inserting the following definition after the definition of first year : hire and drive vehicle means a vehicle that is registered as a hire and drive vehicle in accordance with section 14A of the Traffic Act 1925 ; (b) by inserting the following definitions after the definition of pensioner : public passenger vehicle means a public passenger vehicle within the meaning of the Passenger Transport Act 1997 ; Registrar means the Registrar of Motor Vehicles appointed under regulation 3 of the Traffic (Miscellaneous) Regulations 1968 ; (c) by omitting the definition of severely disabled person and substituting the following definition: severe disability means a permanent disability which, in the Registrar’s opinion, prevents a person from using public transport without assistance; 5Clause 7 amended (Maximum premium for pensioner, &c.) Clause 7 of the Principal Order is amended by omitting paragraphs (b) and (c) and substituting the following paragraphs: (b) a person who has a severe disability; (c) a parent or guardian of a person who has a severe disability and has not attained the age of 16 years. 6Schedule 1 amended (Category 1, 2, 3 and 4 motor vehicles) Schedule 1 to the Principal Order is amended by omitting Part 3 and substituting: PART 3Category 3 motor vehicle

(a) is licensed as a taxi under the Taxi and Luxury Hire Car Industries Act 1995 ; or
(b) is licensed as a luxury hire car under Part 4A of the Taxi and Luxury Hire Car Industries Act 1995
3.	Medium passenger vehicle	A public passenger vehicle (other than one referred to in item 2 ) that –	215
(a) is used to carry no more than 16 passengers; or
(b) is equipped to draw one or more trailers and used to carry no more than 16 passengers
4.	Large passenger vehicle	A public passenger vehicle that –	351
(a) is used to carry more than 16 passengers; or
(b) is equipped to draw one or more trailers and used to carry more than 16 passengers
5.	Hire and drive vehicle	A motor vehicle let for hire without the services of a driver –	351
(a) in this State only; or
(b) both in this State and in one or more of the following jurisdictions:
(i) Victoria;
(ii) New South Wales;
(iii) Queensland;
(iv) South Australia;
(v) Western Australia;
(vi) Australian Capital Territory;
(vii) Northern Territory
6.	Heavy goods vehicle	A motor vehicle –	215
(a) constructed principally for the carriage of goods; and
(b) with a gross vehicle mass exceeding 4.5 tonnes

7Transitional provisionNotwithstanding clause 2 , the amendments made by this order to Schedule 1 to the Principal Order are taken not to apply to or in relation to a motor vehicle until the date on which the next premium would ordinarily become payable to the Motor Accidents Insurance Board in respect of that motor vehicle.
