This regulation may be cited as the Government Owned Corporations Legislation Amendment Regulation (No. 1) 1998 . ˙ Commencement 2. This regulation commences on 20 July 1998. PART 2—AMENDMENT OF GOVERNMENT OWNED CORPORATIONS REGULATION 1995 ˙ Regulation amended in pt 2 3. This part amends the GovernmentOwnedCorporationsRegulation 1995 . ˙ Amendment of s 2 (Commencement) 4. Section 2— omit . ˙ Replacement of pts 2 and 3 5. Parts 2 and 3— omit, insert —

s5 4 s5 Government Owned Corporations Legislation No. 202, 1998 Amendment (No. 1) ‘ PART 2—CANDIDATE GOCS, GOCS AND GOC SUBSIDIARIES ˙ ‘ Candidate GOCs ‘ 5. Each government entity mentioned in schedule 1 is nominated to be a candidate GOC. ˙ ‘ Government entities declared to be GOCs under other regulations ‘ 6.(1) Schedule 2 lists certain government entities that have been declared under other regulations to be GOCs. ‘ (2) Schedule 2 is included for information purposes. 1 ˙ ‘ Government entities that continue to be GOCs under this regulation ‘ 7. Each government entity mentioned in schedule 3 continues under this regulation as a GOC. ˙ ‘ GOC subsidiaries ‘ 8.(1) Schedule 4 lists certain government entities that became subsidiaries of one or more GOCs under other regulations. ‘ (2) Schedule 4 is included for information purposes. 1 If a government entity is declared a GOC under another regulation, that regulation is repealed and the government entity continues as a GOC under section 7, the entity is not listed in schedule 2 but is listed in schedule 3.

For section 128(1) 2 of the Act, each company GOC subsidiary mentioned in schedule 5 is prescribed. ‘ PART 4—APPLICATION OF CHAPTER 3 OF ACT TO CERTAIN COMPANY GOC SUBSIDIARIES ˙ ‘ Company GOC subsidiaries prescribed—Act, s 177 ‘ 10. For section 177(1) 3 of the Act, each company GOC subsidiary mentioned in schedule 6 is prescribed.’. ˙ Amendment of sch 2 (GOCs) 6.(1) Schedule 2, heading— omit, insert — ‘ GOCS DECLARED UNDER OTHER REGULATIONS ’. s 10 8 s 12 Government Owned Corporations Legislation No. 202, 1998 Amendment (No. 1) PART 3—AMENDMENT OF GOVERNMENT OWNED CORPORATIONS (QUEENSLAND CORRECTIONS CORPORATISATION) REGULATION 1997 ˙ Regulation amended in pt 3 10. This part amends the GovernmentOwnedCorporations(Queensland Corrections Corporatisation) Regulation 1997 . ˙ Amendment of s 3 (Purpose) 11. Section 3, before paragraph (a)— insert — ‘(aa)to continue QC in existence; and’. ˙ Insertion of new pt 1A 12. After section 6— insert — ‘ PART 1A—CONTINUATION OF QC ˙ ‘ QC continued ‘ 6A.(1) The entity called Queensland Corrections continues in existence. ‘ (2) Without limiting subsection (1), QC continues— (a) to be a body corporate; and (b) to have a seal; and (c) to be able to sue and be sued in its corporate name. 5 ’. 5 QC was established and incorporated under the Government Owned Corporations(Queensland Corrections) Regulation 1997 , sections 4 and 6. That regulation has now been repealed.
