AN ACT to amend the Government Employees

(Promotions Appeal Board) Act, 1945-1952.

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

and citation

1. (1) This Act may be cited as the Government Employees (Promotions Appeal Board) Act Amend- ment Act, 1953.

(2) In this Act the Government Employees (Promotions Appeal Board) Act, 1945-1952,

Act No. 38 of 1945 as amended by Acts Nos. 33 of 1946, 15 of 1949, 54 of 1951 and 53 of 1952.

is referred to as the principal Act.

(3) The principal Act as amended by this Act may be cited as the Government Employees (Promo- tions Appeal Board) Act, 1945-1953.

2. Paragraph (b) of the proviso to subsection (1) of section five of the principal Act is amended by adding after the word, "section" being the last word in the paragraph the words, "unless the Governor declares upon special grounds that this paragraph does not apply in respect of the vacancy or new office".

2. Subsection (3) of section fourteen of the LInaed.

principal Act is amended by adding after the word, "conduct" in line four the words, "but in considering efficiency the recommending authority and the Board shall disregard service in such office in an acting capacity by applicants for the office to be filled".
