CaseChat Overview and Summary
The legal issues before the Commission included whether the agreement provided for appropriate minimum entitlements, if the agreement contained provisions that were contrary to the public interest, and whether the agreement was made in good faith and the appropriate manner. The Commission had to examine whether the terms of the agreement were fair and reasonable, taking into account the relevant legislative framework, including the Fair Work Act 2009.
The Fair Work Commission determined that the agreement met the requirements for approval. The Commission found that the agreement provided for appropriate minimum entitlements, contained no provisions contrary to the public interest, and was made in good faith and in the appropriate manner. The Commission was satisfied that the agreement was fair and reasonable, and approved it under section 233 of the Fair Work Act 2009. The Goulburn Valley Regional Library Corporation Enterprise Agreement 2022 was thus approved and will govern the employment terms and conditions of the employees for the specified period.
