1 Name of Plan
This Plan is Goulburn Mulwaree Local Environmental Plan 2009 (Amendment No
21).
2 Commencement
This Plan commences on the day on which it is published on the NSW legislation
website.
3 Land to which Plan applies
This Plan applies to the following land in Goulburn—

4 Maps
The maps adopted by Goulburn Mulwaree Local Environmental Plan 2009 are
amended or replaced, as the case requires, by the maps approved by the local
plan-making authority on the making of this Plan.

[1] Schedule 1 Additional permitted uses
Insert “, and identified as “Item 1” on the Additional Permitted Uses Map” after “DP
1069310” in clause 1(1).

4 Use of certain land at Goulburn
|
Additional Permitted Uses Map.
| (2) | Development for the purposes of intensive livestock agriculture, in relation to | |
| horses, is permitted with development consent. | ||
| (3) | Development consent must not be granted under this clause unless the consent | |
| authority is satisfied the development— | ||
|
(i) to prevent adverse impacts on water quality and ensure an overall
neutral or beneficial impact on water quality during construction
and operation of the site,
(ii) to avoid significant effects on the environment that would cause
avoidable erosion or siltation,
(iii) to limit sources of pathogens or nutrients and prevent pathogens
or nutrients, or contaminants leaching from them, reaching
watercourses, waterbodies or drainage depressions,
(iv) to minimise land use conflicts and ensure the amenity of nearby
residential properties, and
| (b) | is separated from the following— | |||

| (c) | will not cause avoidable erosion, siltation, destruction of riparian |
vegetation or a reduction in the stability of riverbanks or watercourses,
and
| (d) | will not result in keeping horses on a lot with an area of less than |
2000m2 or keeping more than the following number of horses—

every 2000m2 of land,
(ii) in relation to keeping horses in open areas, for example paddocks
and holding yards—2 horses for a minimum area of 2000m2 of

land plus 1 additional horse for every 1000m2 of land greater than
2000m2.
| (4) | Subclause (3)(b)(i) does not apply to development for the purposes of |
| environmental protection works. |
