a n d Charles Gillespie have been duly appoin ted and now are the Trus tees of t h e land a t Gou lbu rn dedicated as a site for an hospi ta l wh ich said land is more par t icu la r ly described in t h e Schedule hereto A n d whereas t h e bui ld ings erected on the said l and are inadequa te and unfit for t he r equ i rement s of the distr ict and the site has become unsu i t ab le for t he purposes of a publ ic hospi tal A n d whereas it is expedient t h a t provision should lie m a d e upon the acquisi t ion of a be t te r site for the erection thereon of sui table bui ld ings for such hospital and t h a t t h e Trustees for t he t ime be ing of t he said land should be empowered to sell a n d dispose of t h e same in order to raise a s u m of money to be expended in defraying p a r t of t h e cost of e rec t ing on such be t te r site sui table bu i ld ings for t he said hospi ta l Be it therefore enacted by t h e Queen ' s Mos t Exce l len t Majesty b y and w i t h the advice and consent of t h e Legis la t ive Counci l and Legislat ive Assembly of N e w South "Wales in Pa r l i amen t assembled and by the au thor i ty of t h e same as follows :—

1. I t shall be lawful for t he Trus tees for t he t ime be ing of t he said Gou lbu rn Hosp i t a l to sell and dispose of t he said parcel of land described in t he Schedule here to by publ ic auct ion or pr iva te con t rac t and ei ther in one lot or in several lots as they shall deem expedient for

such price or prices as can be reasonably had or obta ined for t h e same a n d to convey and assure t he same or a n y por t ion or port ions thereof

w h e n sold to t h e pu rchase r or purchasers thereof in fee s imple freed
and discharged from all t r u s t affecting t he said land A n d t h e rece ip t

in wr i t ing of t he said Trus tees for t h e purchase money ar is ing from such sale or sales shal l be a sufficient d ischarge to any and every pur ­ chaser of t h e said land or por t ions thereof and exonera te such p u r c h a s e r from seeing to the appl icat ion of t h e said moneys and from al l l iabi l i ty

in respect of t h e misappl icat ion or non-appl icat ion thereof.

2. I t shall be lawful for t h e Trus tees a n d the i r successors to
allow any purchaser or purchasers credit for t h e p a y m e n t of t h e who le

or a n y p a r t or pa r t s of his he r or the i r pu rchase money upon such t e rms

as to in teres t or o therwise and general ly as t h e Trustees m a y deem
reasonable and expedient .

3. The said Trustees a n d the i r successors shall s tand possessed
of t he moneys ar is ing from such sale or sales as aforesaid u p o n t r u s t to

app ly t h e proceeds thereof in or towards t h e erect ion of a pub l i c hospi ta l

in t h e town of or in the vicinity of t he town of Gou lbu rn u p o n a sui t ­

able site for t h a t purpose. A n d t h e said Trus tees and the i r successors shall also s tand possessed of any moneys voted or to be voted b y Pa r ­ l i ament in aid of t he bu i ld ing fund of t h e said hospi ta l and also all o ther moneys coming to the i r hands as such Trus tees u p o n the l ike t rus t s as are hereinbefore declared in respect of t h e proceeds of sale of t he said l and And the receipts of a n y person or persons to w h o m a n y moneys shall be paid by the said Trus tees or the i r successors u n d e r t he provisions of this A c t shall be a val id and comple te discharge to t he

said Trustees a n d the i r successors for such moneys .

4. N o expend i tu re of any of t h e said moneys shall be m a d e
upon any new site unless such new site shal l have been approved b y

t h e Governor w i th t h e advice of t he Execu t i ve Counci l A n d al l

bui ld ings offices and the i r appur tenances to be erected on t h e l and so
approved of shal l be cons t ruc ted according to plans a n d specifications
to be approved of by t he Colonial Arch i t ec t .
5. N o Trus tee or Trus tees u n d e r th i s A c t shall be held respon­
sible for a n y invo lun ta ry losses or misappl ica t ion of any moneys
coming to t he hands of t h e said Trustees u n d e r t h e provisions of th i s
A c t unless such loss or misappl ica t ion shal l have happened t h r o u g h
t h e wilful neglect or defaul t of t h e Trustees u n d e r th i s A c t for t h e
t ime be ing .
G. This Act may be cited as t he " G o u l b u r n Hosp i t a l Site Sale
A c t of 1884 . "
