CaseChat Overview and Summary

The Goulburn Ovens Institute of TAFE applied to the Fair Work Commission for the approval of an enterprise agreement under the Fair Work Act 2009. The application was made by the employer, Goulburn Ovens Institute of TAFE, and the unions involved were the Australian Education Union, Tertiary Education Union and the National Tertiary Education Union. The nature of the dispute involved the terms and conditions of employment for the employees of the Institute, including wages, hours of work, and other employment-related matters.

The legal issues that the Commission was required to decide included whether the agreement met the "better off overall test" and whether it contained any terms that were contrary to public policy or contrary to the spirit of the Act. The Commission also needed to determine whether the agreement had been made in good faith and whether it had been properly negotiated. Additionally, the Commission needed to consider whether the agreement provided for proper processes for the resolution of employee grievances and disputes.

The Commission found that the agreement met the "better off overall test" and that it did not contain any terms that were contrary to public policy or the spirit of the Act. The Commission also found that the agreement had been made in good faith and that it had been properly negotiated. The Commission further found that the agreement provided for proper processes for the resolution of employee grievances and disputes. As a result, the Commission approved the agreement.

The Fair Work Commission approved the Goulburn Ovens Institute of TAFE Enterprise Agreement 2015. The approval was subject to the agreement being registered with the Registrar of the Commission. The agreement will now apply to the employees of the Institute and will remain in force until it is terminated or varied by a future agreement.
