1      Name of Plan

This Plan is Gosford Local Environmental Plan No 477.

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to part of Lots 1 and 4 and Lots 5–8, DP 270678 and part of SP 84324, being land at Manns Road, West Gosford, as shown edged heavy black on the map marked “Gosford Local Environmental Plan No 477” deposited in the office of Gosford City Council.

Clause 49DO

Insert after clause 49DN:

49DO

Bulky goods premises at Manns Road, West Gosford

(1)

This clause applies to part of Lots 1 and 4 and Lots 5–8, DP 270678 and part of SP 84324, Manns Road, West Gosford, as shown edged heavy black on the map marked “Gosford Local Environmental Plan No 477” deposited in the office of the Council.

(2)

Development may, with development consent, be carried out on land to which this clause applies for the purpose of bulky goods premises with a maximum floor space of 12,500 square metres.

(3)

In this clause, bulky goods premises means a building or place the principal purpose of which is the sale, hire or display of bulky goods, being goods that are of such size or weight as to require:

(a)

a large area for handling, display or storage, and

(b)

direct vehicular access to the site of the building or place by members of the public for the purpose of loading or unloading such goods into or from their vehicles after purchase or hire,

and including goods such as floor and window supplies, furniture, household electrical goods, equestrian supplies and swimming pools, but does not include a building or place used for the sale of foodstuffs or clothing unless their sale is ancillary to the sale or hire or display of bulky goods.
