[1] An Application pursuant to s.318 of the Fair Work Act 2009 (the Act) for an order relating to an instrument covering a new employer and transferring employees was filed by Goodlife Health Clubs on 27 July 2012.
[2] Goodlife Health Clubs became the new employer on 12 April 2010 following the purchase of Zest Health Clubs at Bibra Lake, Joondalup, Kingsway and Mount Lawley by its parent company Ardent Leisure Limited.
[3] A notice of listing was issued on 8 August 2012 directing the Applicant ensure that employees at Bibra Lake, Joondalup, Kingsway and Mount Lawley who would be affected by the proposed order were made aware of the application, the notice of listing and the terms of the order sought.
[4] The Listing invited any person wishing to be heard or make a written statement regarding the application to advise Fair Work Australia prior to the listing. No response was received.
[5] I have considered the matters set out in s.318(3) of the Act and I am satisfied on the basis of supporting documentation provided with the application that the order should be issued.
[6] The Order [PR528476] will come into operation on 28 August 2012.
