No. 12 of 1933.

AN ACT to revest in His Majesty certain Allotments of Land in or near Kalgoorlie, Boulder, Southern Cross, Brown Hill, Trafalgar, and Coolgardie and for other purposes incidental thereto.

[Assented to 26th October, 1933.1

HEREAS the several allotments of land described in

Wthe Schedule to this Act have hitherto and still are

rateable land for the purposes of the Goldfields Water Supply Act, 1902, and the Minister charged with the administration of the said Act has from time to time assessed the said allot- ments for water rates under the said Act: And whereas the Owners of the said allotments having made default in pay- ment of water rates and being unable to pay or to continue to pay water rates in respect of their said allotments, have. from time to time by mutual arrangements with the Minister requested him to accept from such owners surrenders to His. Majesty of their said allotments, and in consideration thereof' to discharge the said owners from their liability to pay water rates then due and thereafter to become payable in respect of their said allotments: And, pursuant to such arrangement, the owners have delivered to the Minister or to the Registrar of Titles the instruments of title of their said allotments as and by way of surrender thereof to His Majesty, and the Minister has discharged the said owners from liability to pay water rates then due, and has thereafter exempted the said allotments from assessment of water rates: And whereas the

Minister and the Registrar of Titles are now holding the said instruments of title of the said allotments of land, but diffi- culties have arisen in relation to effectuating the surrenders of the said allotments so as to vest the same in His Majesty: And whereas it is now deemed expedient and desirable to revest the said allotments of land in His Majesty in order to give effect to the surrenders aforesaid: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legis- lative Assembly of Western Australia. in this present Par- liament assembled, and by the authority of the same, as follows :-

1.    This Act may be cited as the Goldfields Allotments Short title.

Revestment Act, 1933, and shall come into operation on a

day to be fixed by proclamation, which day shall not be earlier

than three months after the passing of this Act.

may have at any time been vested by statute or otherwise in the persons mentioned in the third column of the Schedule to this Act, or in any other person or persons whomsoever in any of the lands described in the first and second columns of the said Schedule, shall absolutely cease and determine. and all and singular the said lands, and all the estate, right. and title in law or in equity thereto, shall be and the same are hereby vested in Es Majesty freed, released, and dis- charged of and from all rates and taxes then charged upon or owing in respect of the said lands, and of and from all encumbrances, and the estate, right, title, interest, claim, or demand of any person whatsoever.

Titles, the Registrar of Deeds, and every other registrar or

person having the custody or control of any register or public 'eV/LT:sant

record, are hereby authorised to make, and shall make, in the registers'

requisite to complete and effectuate the revestment of the

said lands in His Majesty as aforesaid and otherwise to give

effect to this Act.

5. (1.) The Minister may, at any time prior to the com-

(2.) Upon receipt of a direction in writing from the Minister under subsection (1) of this section, the Registrar of Titles or other person to whom such direction is addressed shall forthwith comply with and give effect to such direction.

The Minister may impose any conditions he may think fit as conditions precedent to the return of any instru- ment of title under this section, and may require such con- ditions to be observed and complied with before he returns or directs the return of such instrument of title.

(3.)

When the Minister returns an instrument of title as provided for in subsection (1) hereof, he shall forthwith give notice thereof in writing under his hand to the Registrar of Titles and the Minister for Lands, and thereupon the allot- ment of land comprised in the instrument of title mentioned in such notice shall be deemed to be excluded from the Sche- dule to this Act, and section two of this Act shall not apply to such allotment of land.

(4.)

(5.) When the Minister directs the Registrar of Titles or any other public officer to return an instrument of title as provided for in subsection (1) of this section, the Minister shall forthwith give notice of such direction to the Minister for Lands, and also to the Registrar of Titles, where the direction is given to a public officer other than the Registrar of Titles, and thereupon the allotment of land comprised in the instrument of title directed to be returned as aforesaid shall be deemed to be excluded from the Schedule to this Act, and section two of this Act shall not apply to such allotment of land.

(6.) For the purposes of this section, the term "the Minister" means the Minister of the Crown for the time being or from time to time charged with the administration of the Goldfields Water Supply Act, 1902.
