An Act to confer upon the Warden of a Goldfield the

Powers of a Licensing Bench.

[Assented to 3rd December, 1888.

E it enacted by His Excellency the Governor of Western Aus-

tralia and its Dependencies, by and with the advice and con-

sent of the Legislative Council thereof, as follows :—

1. A Warden of a proclaimed Goldfield shall have all the powers Warden of Gold-

and authority of a Bench of Licensing Magistrates in respect of the fipeo,aye,:inee„..

granting of the licenses hereinafter mentioned, which licenses shall be sins Much

in force to the end of the year in which the same shall be granted

respectively in the forms following :-

(1) A Publican's General License in the form contained in the

l 4A tst-Schedule.

(2) AA,Tiine and Beer License in the form contained in theSecond Schedule. gt,...

(3) A Spirit Merchant's License in the form contained in the

Third Schedule.

(4) A Gallon License in the form contained in the Fourth

Schedule. °

(5) 46agiitafAtirie License in the form contained in the Fifth

Schedule.

(0) An Eating, Boarding, and Lodging House License in the

form contained in the Sixth Schedule.

(7) A Wayside House License in the form contained in the

Seventh Schedule.

2. An application for any one of the said Licenses shall be in the form appropriate to such license as is in the Twelfth Schedule to The	Form of applica-
tion for License
Wines, Beer, and Spirit Sale Act, 1880' contained, save and except that such application shall be addressed to the Warden of a Goldfield in manner following, namely, ' To the Warden of Gold- field.'

3. 'The Wines, Beer, and Spirit Sale Act, 1880,' and any Act Construction

amending the same passed or to be passed, shall be read and construed together with this Act in so far as the said Acts are not repugnant to or inconsistent with the provisions of this Act. Provided it shall not be necessary to give the notices required by that Act.

4. Whenever it shall appear to the Governor in Council that it is expedient that the provisions of this Act shall no longer apply to any Goldfield it shall be lawful for him, by Proclamation in the ' Govern- ment Gazette, to direct that the said provisions shall no longer apply

thereto, and upon publication of such Proclamation the provisions of

this Act shall no longer apply to such Goldfield.

Short title 5. This Act may be cited as The Goldfield Licensing Act, 1888.'

FIRST SCHEDULE

FORM OF A PUBLICAN'S GENERAL LICENSE

Whereas A.B., of , bath applied to me for a

Publican's General License for the house known (or to be known) by the sign of

, situated at in the

Goldfield, and I have thought fit to grant such application ; And whereas the said LB. has paid into my office the sum of pounds sterling as duty on such license ; Now I, by virtue of the powers vested in me, hereby license the said A.B. to keep a common inn, alehouse, or victualling house, and to sell liquor in

any quantity in the house in which he now dwelleth (or is about to dwell), being

the sign of situated at aforesaid, and in the appurtenances thereto belonging, but not elsewhere ; and this license shall commence upon the first day of next, and continue in force until the thirty-first day of December then next ensuing, both days inclusive, pro- vided it be not forfeited in the meantime.

SECOND SCHEDULE

FORM OF A WINE AND BEER LICENSE

to wit.

Whereas A.B., of 'lath applied to me for a license for

the sale of wine and beer, the produce of the Colony, in the house of the said A.B., situated at , in the ' Goldfield, and I have thought fit to grant such application ; And whereas the said A.B. has paid into my office the sum of pounds sterling, as the duty upon such license : Now I do hereby license the said A.B. to sell wine and beer, the produce of the Colony, in

any quantity, in the house in which he now dwelleth (or is about to dwell), situated

at aforesaid, and in the appurtenances thereto belonging, but

not elsewhere; and this license shall commence from the day of

next, and continue in force until the thirty-first day of December then next ensuing, both days inclusive, provided it be not forfeited in the mean- time ; and provided that the said A.B. shall not sell or dispose of, or permit to be

sold or disposed of, any spirituous liquor, or mixed liquor part whereof is

spirituous, in the said house or its appurtenances, in which case this license shall

THIRD SCHEDULE

FORM OF A SPIRIT MERCHANT'S LICENSE

to wit. I

Whereas A.B., of lath applied to me for a

Spirit Merchant's License for the premises of the said A.B. situated at

in the Goldfield, and I have thought fit to grant

such application ; And whereas the said A.B. has paid into my office the sum of

pounds sterling as the fee on such license : Now I do hereby license

the said A.B. to sell and dispose of any imported spirituous liquors or wine in

quantities not less than two gallons, or any other imported fermented liquors in

quantities not less than eight gallons. This license does not authorise the

licensee to sell any such liquor except in the casks or cases in which such liquor

was imported. And this license shall commence on the

of next and continue in force until the thirty-first day of December

then next ensuing, both days inclusive, provided it be not forfeited in the mean-

time.

FORM OP A GALLON LICENSE

to wit

Whereas A.B., of bath applied to me for a

Gallon License for the shop (or rooms) of the said A.B., situated at

in theGoldfield, and I have thought fit to grant such application ; And

whereas A.B. has paid into my office the sum of pounds sterling, as the

fee on such license : Now I do hereby license the said A.B. to sell and dispose of

liquors in quantities not less than one gallon, so that such liquor shall not be

drunk on the premises above described, and shall consist of but one description of

liquor, and be delivered and shall be taken away from the premises at one and

the same time, and not by instalments, at the time of sale. And this license shall

commence on the day of next, and continue in

force until the thirty-first day of December then next ensuing, both days inclusive,

provided it be not forfeited in the meantime.

License for the shop (or premises) of the said A.B., situated at in

the Goldfield, and I have thought fit to grant such application ;

And whereas the said A.B. has paid into my office the sum of pounds sterling, as the fee on such license : Now I do hereby license the said A.B. to sell any wine, cider, or perry, the produce of fruit grown in the Colony, in quantities of not less than one pint, the said wine, cider, or perry not to be consumed in the shop (or on the premises) of the said A.B. And this license shall commence on the day of next, and continue in force until the thirty-first day of December then next ensuing, both days inclusive, provided it be not forfeited in the meantime.

ing, Boarding, or Lodging House License (as the case may be) for the house situated at in the Goldfield, and I have thought fit to grant such application ; And whereas the said A.B. has paid into my office the sum of pounds sterling as duty on such license: Now I do hereby license the said A.B. to keep an eating, boarding, or lodging house (as the case

may be) open to the public, in the house situated at in the

Goldfield aforesaid, but not elsewhere ; and this license shall commence upon the

day of next, and continue in force until the thirty-first day

of December then next ensuing, both days inclusive, provided it be not forfeited in

the meantime.
