To allow the Council to subsequently pass a resolution refusing the application would usurp the Court's statutory authority and create an untenable situation where two bodies could purport to make a final decision on the same development application. The Court applied the principle that where a statute confers a right of appeal to a superior tribunal, the original decision-maker's power to revisit or confirm its decision is extinguished upon the lodging of that appeal.

The High Court allowed the appeal, setting aside the orders of the Supreme Court of New South Wales and quashing the resolution of the Kogarah Municipal Council.
