418 Golden Casket Art Union Act and Another Act Amendment Act 1984, No. 40 BE IT ENACTED by the Queen ' s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same , as follows:- PART I-PRELIMINARY 1. Short title . This Act may be cited as the Golden Casket Art Union Act and Another Act Amendment Act 1984. 2. Arrangement of Act. This Act is arranged as follows:- PART I-PRELIMINARY (Ss. 1-2); PART II-AMENDMENT OF THE GOLDEN CASKET ART UNION ACT 1978-1981 (ss. 3-8); PART III-AMENDMENT OF THE ART UNIONS AND AMUSEMENTS ACT 1976-1981 ( ss. 9-11). PART II-AMENDMENT OF THE GOLDEN CASKET ART UNION ACT 1978-1981 3. Citation . (1) In this Part the GoldenCasket Art Union Act1978-1981 is referred to as the Principal Act. (2) The Principal Act as amended by this Part may be cited as the Golden Casket'Art Union Act 1978-1984. 4. Amendment of s. 4. Interpretation . Section 4 of the Principal Act is amended by- (a) omitting the definition " art union " and substituting the following definition:- " " art union " means a scheme or device for the gift, disposal or distribution of any prize or any right thereto or share therein that may by this Act be a prize in a Golden Casket depending upon or to be determined by lot or a drawing (whether from a receptacle or by means of a machine or other equipment) or any manner of chance whatsoever conducted in accordance with the provisions of this Act relating to Golden Caskets;"; (b) inserting after the definition " Office " the following definition: " " ticket " means a document, card, envelope or thing that evidences or is intended to evidence the right of a person to participate in an art union;". 5. Amendment of s. 13. Supervision of drawings , maintenance and security of equipment . Section 13 of the Principal Act is amended by adding at the end of the first paragraph, after the word " Casket " the words " in which the disposal or distribution of the prize or prizes is to be determined by a drawing ".

Golden Casket Art Union Act and Another Act Amendment Act 1984, No. 40 419 6. New s. 13A. The Principal Act is amended by inserting after section 13 the following section:- " 13A. Office not limited in conduct of art unions . No provision of this Act shall be construed to imply that the Office cannot conduct an art union in which the disposal or distribution of the prize or prizes is to be determined otherwise than by lot or a drawing.". 7. Amendment of ss . 11 and 17 . The provisions of the Principal Act specified in the first column of the following Table are amended as set out in the second column of that Table:- TABLE Section 11, paragraph (a) Section 17 omit the words " by the Office " omit the words "conducted by the Office ". 8. New s. 24. The Principal Act is amended by adding after section 23 the following section:- " 24. Rules . (1) The Office may, with the approval in writing of the Minister, make rules not inconsistent with this Act or the regulations for or with respect to Golden Caskets and the conduct by it of such Golden Caskets. (2) Section 28A of the Acts Interpretation Act1954-1977 applies in respect of rules made under this Act as if they were regulations.". PART 111-AMENDMENTS OF THE ART UNIONS AND AMUSEMENTSACT1976-1981 9. Citation . (1) In this Part, the Art Unions and Amusements Act1976-1981 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Art Unions and Amusements Act1976-1984. 10. Amendment of s. 17. Restriction on permissible prizes. Section 17 of the Principal Act is amended by, in subsection (1) (c), omitting the words " Vagrants, Gaming and Other Offences Act1931-1971 " and substituting the words " Golden Casket Art Union Act1978-1984 ".
