An Act to amend the Gold and Mineral Dredg ing

Act, 1809. [17th December, 1902.]

BE it enac ted by the K i n g ' s Mos t Exce l len t Majesty, by and with,

t h e advice and consent of t he Legislat ive Council and Legislat ive Assembly of N e w South Wales in P a r l i a m e n t assembled, and by

the

a u t h o r i t y of t h e same, as follows :—
1. This A c t m a y be cited as t he " Gold and Minera l Dredg ing
(Amend ing ) Ac t , 1902,"' and shall be cons t rued wi th t he Gold and
Mine ra l Dredg ing Ac t , ]S99 , hereinaf ter in this A c t t e rmed the
Pr inc ipa l Act .

2. The year ly r en t payable to t he Crown for any Crown land comprised in a lease; unde r t he Pr inc ipa l A c t shall , after t he commence­ m e n t of this Act , be two shill ings and sixpence for every acre of such land.

3. A roya l ty of one per c e n t u m on the value of all gold or o ther minera ls won from any land, leased unde r t he Pr incipal Act , shal l be payable to t h e Crown, a t t he t imes, and in t h e manne r , prescribed by regula t ions , in addi t ion to a n y r en t payable in respect of such land.

4 . W h e r e i t is desired t h a t any lease or leases u n d e r t h e

Pr inc ipa l A c t shall be ama lgama ted w i t h any lease or leases for d redging purposes g ran ted unde r the M i n i n g Ac t of 1874 or t h e

M i n i n g A c t F u r t h e r A m e n d m e n t A c t of 1884, applicat ion m a y be made

such amalgamat ion , and in t h e la t t e r case such ama lgama t ion shall he

effected in such m a n n e r a n d t h e a m a l g a m a t e d leases shal l he subject

to such condit ions as are prescribed b y regula t ions m a d e in t h a t behalf.
5 . The Governor m a y m a k e regula t ions for ca r ry ing ou t t h e
provisions of th is A c t and in pa r t i cu la r for assessing and secur ing the
p a y m e n t of any roya l ty payable t he r eunde r , a n d for t h a t purpose

may in those regula t ions prescribe t h e r e t u r n s to be m a d e by lessees and persons work ing a n y land leased as in section two ment ioned, or receiving gold or o ther minera l s from any such land, and m a y author ise t he e n t r y upon a n y land and t h e t a k i n g of any ore or m e t a l won therefrom, a n d impose any pena l ty no t exceeding fifty pounds for any breach of such regula t ions .
