COMMISSIONER CLOGHAN PERTH, 5 NOVEMBER 2012

Enterprise Agreement.

[1] On 18 June 2012, GMA Cover Australia Pty Ltd made application for approval of a single enterprise agreement to be known as the GMA Cover Australia Enterprise Agreement 2012-2015 (“the Agreement”). The application was made pursuant to s.185 of the Fair Work Act 2009 “(the FW Act”).

[2] On 3 July 2012, my Associate received an email with a revised version of the Agreement.

[3] On 5 July 2012, my Associate received a signature page with the employees’ nominated representative on the revised version of the Agreement.

[4] Following further email communication with the Applicant, a conference took place on 31 July 2012. At the conference, the Applicant advised that it would discontinue this application and file another application.

[5] To date the Applicant has not filed a Notice of Discontinuance with the Tribunal.

[6] I am not satisfied from the material provided to the Tribunal that ss.186, 187 and 188 of the FW Act, as relevant to this application for approval, have been met. Accordingly, the application must be dismissed.
