Application for approval of the Global Foodworks Pty Ltd Employee Collective Agreement 2009—s.181(2)—application refused
[1] This is an application by Global Foodworks Pty Ltd seeking the approval of an enterprise agreement titled Global Foodworks Pty Ltd Employee Collective Agreement 2009 (the Agreement).
[2] The Agreement was made during the bridging period 1 as defined in the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009 (the Transitional Act) Accordingly, when considering whether to approve the Agreement I have taken into account the provisions of Part 2–4 of Chapter 2 of the Act as modified by Schedule 7 of the Transitional Act.
[3] The statutory declaration filed with the application disclosed that the actions of the employer were not in compliance with Section 187 of the Fair Work Act 2009.
[4] Discussions have taken place with the employer and it has been advised that the application will not be approved.
[5] I decline to approve the application.
