and seventy-nine the two several parcels of land described in t h e Schedule here to were granted u n t o the Munic ipa l Council of Glen I n n e s to be used for a site for a town-hal l and publ ic marke t s to be held u n t o t h e said Counci l in t rus t for the erection thereon of a town-hal l and publ ic m a r k e t s and for no o ther purpose whatsoever upon t h e conditions and subject to t h e reservations in t he said deed of g r a n t expressed and subject to t he proviso a m o n g others t ha t if t he said land should be used by t h e grantees for any purposes o ther t h a n for t h e site of a town- hal l and publ ic m a r k e t s t hen t h e said two several parcels of land should be forfeited and rever t u n t o H e r Majesty t h e Queen her he i r s and
successors A n d whereas i t would be more for t h e benefit of t he
Munic ipa l i ty of Glen I n n e s and of t he inhab i tan t s thereof t ha t offices
should be bu i l t upon t h e said land t h a n t h a t publ ic m a r k e t s should be erected thereon in accordance wi th t he t rus t s contained in t he said deed of grant and it is expedient t h a t the said Council should have power to bui ld such offices upon the said land as well as a town-hal l A n d whereas the said Counci l is unable wi th due regard to t h e o ther r equ i rements of t he said Munic ipa l i ty to provide funds for the erect ion of such town-hal l and offices wi thou t bor rowing money u p o n secur i ty of t h e said land and the bui ldings to be erected the reupon and it is expedient tha t t h e said Council should have power and au thor i ty to m o r t g a g e t h e said land and t h e bui ldings to be erected thereon to enable t h e m to provide funds for such erection A n d whereas i t is ex­ pedient t h a t the said Council should have power from t ime to t i m e to lease t he said offices to be erected upon the said land for any t e rms no t exceeding five years Be it therefore enacted by t h e Queen ' s Most Exce l l en t Majesty by and wi th the advice and consent of t h e Legis­ la t ive Council and Legis la t ive Assembly of N e w South Wales in Par ­ l iament assembled and by the au thor i ty of t he same as follows :—
1. I t shall not be necessary for t he Munic ipa l Counci l of Glen
I n n e s to erect or bui ld upon the said parcels of land or e i ther of t h e m
a n y publ ic marke t s a n y t h i n g in t he said here in reci ted g r a n t no twi th­
s t and ing provided t h a t the said Counci l shall erect t he reupon a t own-
hall and such other offices as the said Council shall deem necessary.
2. The said Counci l may raise or borrow money for the purposes of bui ld ing and comple t ing such offices upon the securi ty of the said land and for such purpose m a y mor tgage t he said land or any p a r t thereof and the bui ld ings to be erected the reupon as if the said land and bui ld ings were t he absolute p rope r ty of t he said Council free from a n y t rus t s .
3. Al l moneys so raised by mor tgage or borrowed upon securi ty
of t he said land shall be applied to t he purposes of bu i ld ing and
comple t ing t h e said town-hal l and offices to be erected thereon and for
no

no o ther purpose whatsoever and a detailed account of all moneys so received or paid by the said Council shall be t aken to be included in the detailed account of revenue and expendi tu re required by the one h u n d r e d and e igh ty- th i rd section of t he " Municipal i t ies Ac t of 1867 ."

4. The Council m a y let t he said offices so to be erected upon
leases not to exceed five years provided t h a t such offices shall be let by

public compet i t ion by way of auc t ion or tender and t h a t a reasonable

yearly r e n t be reserved to t he Counci l du r ing the cur rency of such
leases a n d such leases shall conta in t h e usua l covenants .

5. This Ac t may be cited as t h e " Glen Innes M a r k e t s Incasing

A c t 1866."
