1. The applicant seeks special leave to appeal from a judgment of the Full Court of the Federal Court of Australia (Yates, Charlesworth and Rofe JJ), which dismissed an appeal from a judgment of the Federal Court of Australia (Burley J).

2. There is no reason to doubt the correctness of the decision of the Full Court. The proposed appeal is not a suitable vehicle to consider the point of principle that it seeks to raise.

3. Special leave to appeal is refused with costs.
