HEREAS it is desirable to encourage the testing, opening up, and developing of auriferous lands situated upon goldfields at greater depths than those at which such lands have heretofore been worked: And whereas David Elder Reid, John Wilson, and Lewis Porter hav~ severally made application for gold-mining leases of certain lanu situated on the goldfield of Gympie, consisting of four blocks, numbered respectively 1275, 1276, 1277, and 1278, and comprising an area of two hundred acres or thereabouts, and are desirous of test- ing, opening up, and developing the same at deep levels, and for that purpose. require that the same should be held under one gold-mining lease: And whereas under the provisions of " The Mining Act of 1898 "* the area of land which may be held under one gold":mining lease cannot exceed fifty acres: And whereas the discovery of payable gold-bearing stone at deep levels in such land would greatly increase the industry of· mining upon the said goldfield, and would be of manifest public advantage: And whereas, for the purpose of enabling the said perRons to test, open up, and develop such land at deep levels, it is expedient that they should be granted a gold-mining lease comprising the whole of the said * 62 Vie. Glas.gow G.ympie Un£ted Gold Mining Leas.e Act. land, and that the provisions of the said Act should other- wise be varied in their favour: Be it therefore enacted bv the King's Most Excellent Majesty, by and with the advide and consent of the Legislative Council and l"cgislative Assem hly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "Th,., Glasgow Gympie Short title. United Gold Mining Lease Aot of 1902." 2. In this Act the term" the Owners" means David I~ terpreta. Elder Reid, John Wilson, and Lewis Porter, their a,nd t~ on. each of their heirs, executors, administrators, assigns, or successors in interest. 3. Before the expiration of six months after the date Gold-mining of the passing of this Act the Owners shall cause to be ~ ~ ~ ~ t: ~ Y be made at their own expense a pro Der plan of survey of the blocks of land, on the goldfield of Gympie, numbered respectively 1275, 1276, In7, and 1278, in the office of the Warden of the said goldfield, and comprising an area of two hundred acres or thereabouts. Such plan of survey shall be submitted for the approval of the Secretary for Mines. Upon the approval of such plan, and upon the sur- render of all existing gold-mining leases of such land, the Owners shall, notwithstanding the provisions of " The Mining Act q! IS9K," * be entitled to a grant of a gold- mining lease of the land so surveyed, and not exceeding an area of two hundred acres. During the period of eighteen months after the passing of this Act, the lease shall not be subject to any of the provisions of "The Mining Aot of 1898," * or any Act amending or in substitution for that Act, relating to the performance of labour covenants; but, save as by this Act is otherwise provided, such lease shall be sub- ject to all the other provisions of that Act, or any Act amending or in substitution for that Act, so that the pro- visions of the law in force for the time being' relating to gold-mining leases generally shall, save as by this Act is provided, apply to the lease granted under this Act. 4. If, although the Owners before the expiration of such period have not sunk a shaft in such land to the depth hereinbefore prescribed, the ~ ecretary for Mines is neverthe- less satisfied that such shaft has been so sunk to the depth of at least two thousand five hundred feet, and that the delay in sinking the same to the prescribed depth has occurred through circumstances for which the Owners can- not justly be held responsible, then the Secretary for Mines may extend the time for sinking such shafL to the prescribed depth for a further period of one year. . The Owners or any sublessees from them shall, at the end of each month after commencing work, lodge with the warden of the Gympie Gold Field, for public information, the following particulars, viz. :- 1.'he distance sunk, with full details of· the strata passed through in so sinking, and a full description of all veins of quartz or other lode matter passed through. A failure to comply with the provisions hereof shaH render the Owners or such sublessees liable to a fine for each offence of fifty pounds, and for the forfeiture of the lease on non-payment of such fine. If. the Owners make default in complying with the provisions of this section within the period prescribed, or, if the period is extended as aforesaid, withIn such extended period, then, without any authority or process other than this Act, the lease granted in pursuance of the last pre- ceding section shall be liable to forfeiture. to Hone;r 5. Before the expiration of six months after the date : ~ : . lts be of the passing of this Act, the Owners shall place the sum of five thousand pounds on deposit, in the name of the Secretary for Mines, in the Government Savings Bank at Brisbane, and shall deliver to him the deposit receipt for such sum. Before the expiration of twelve months after the date of the passing of this Act, the Owners shall place the further sum of five thousand pounds on deposit, in the name of the Secretary for Mines, in the said Bank, and shall deliver to him the deposit receipt for such sum. The several sums of money deposited as aforesaid shall, save as hereinafter mentioned, be held by the Secre- tary for Mines as security for the due compliance by the Owners with all the provisions of this Act: Provided that when and so often as the Warden of the Gympie Gold Field is satisfied that the Owners have

Pensions Validatin.1J Act. ---- - - ~- - -- - - expended in or in connection with the sinking of a shaft in the land comprised in the lease aforesaid moneys amounting to five hundred pounds or upwards he shall certify in writing accordingly, and thereupon the Owners shall be entitled to withdraw from the said Bank the sum .so certified to have been expended, or if the balance l'emaining on deposit does not amount to the sum so certi- fied then the balance remaining on deposit, and so from time to time until all the moneys so deposited have been. withdrawn pursuant to such certificates. If the Owners make default in compliance with any of the provisions of this Act, the alHount of money, if any, then remaining on deposit in the said Bank and held by the Secretary for Mines by way of security as aforesaid shall, without any authority or process other than this Act, be liable to forfeiture. 8581 PENSIONS. "l"XTIIEREAS by section eight of" The Civil Service l'reamble. " " Act of 1863"* it is provided that when the services of any officer in the Public Service to whom that Act applies are dispensed with, not through any fault of his own, he shall receive compensation according to a scale prescribed by the said section: And whereas by section seventeen of the said Act it is further provided that certain sums shall be deducted from the salaries of officers of the Public Service to whom the said Act applies, and paid to the Con- solidated Revenue, and that every officer from whom such deduction has been made, and who has attained the age of sixty years, or is incapacitated through illness, shall retire from active service, and shall receive a retiring allowance according to a scale prescribed by that section: And whereas it has been found expedient to dispense with the services of certain of the said officers, whose names are mentioneil in the Schedule to this Act, before ,those officers have re~ pectively attained the age of sixty years: ------ ------------- - - - - - - - - * 27 Vie.
