FAIR WORK AUSTRALIA

EX TEMPORE DECISION

Fair Work Act 2009
s.394—Application for unfair dismissal remedy

Giuseppe Conforto
v
Bundoora Bakehouse
(U2011/14774)

DEPUTY PRESIDENT SMITH

MELBOURNE, 4 APRIL 2012

No appearance at the scheduled hearing; application filed out of time; matter dismissed.

[1] The following decision, now edited, was issued on 16 March during proceedings.

[2] Mr and Mrs Jones thank you for your attendance, the applicant has not attended.

[3] The applicant made an application on 20 December 2011 and he was dismissed on 14 October 2011. This means that the application has been filed out of time. There is nothing in the applicant’s material which would indicate to me that I should grant an extension of time and given that the applicant has failed to appear at the hearing today, to seek an extension of time and to outline his reasons for the delay in making the application, I refuse to grant an extension. This application is struck out.

DEPUTY PRESIDENT
