GEORGES RIVER BRIDGE ACT.

Act No. 23, 1923.

3. The council of t he Shi re of S u t h e r l a n d is he reby

au thor i sed and empowered to cons t ruc t a br idge wi th t h e necessary approaches over the George 's River, tin; cent res of t h e piers and a b u t m e n t s to be on or adjacent to a l ine jo in ing a point about seventy-five feet wester ly from the cen t re of t he p u n t r a m p a t h igh-wate r m a r k ,

be p a r t of t he cost of t he br idge.

(1) The said br idge shall he cons t ruc ted in accord­

ance wi th plans and specifications to be suppl ied by the
Minis te r .

(2) The cost of and incidenta l to t h e p repara t ion
of such p lans and specifications shall be deemed to

necessary outs ide t he Shire of Su the r l and .

(2) A n y land necessary for t he w o r k m a y be

acqu i red unde r t h e provisions of sections five h u n d r e d
and t h i r t y - t w o , five hund red and thir ty-f ive, a n d five
h u n d r e d a n d th i r ty -s ix of t he Loca l Gove rnmen t Ac t ,
1919.

6.      (1) The counci l m a y raise a special loan to defray

t h e cost of cons t ruc t i ng t h e br idge a n d of t h e land
acqu i red in connec t ion the rewi th .
(2) The a m o u n t of t he loan shall be approved

b y the Governor .

(3) N o t w i t h s t a n d i n g a n y t h i n g conta ined in t h e

Loca l Gove rnmen t Act , 1919, i t shall no t be necessary to t ake a poll of ra tepayers before ra i s ing t he loan, or t o otherwise comply wi th t h e provisions of t h e said A c t in respect of t h e loan excep t as here in provided.

(4) The counci l m a y cha rge t he r evenue received

f rom tolls or charges w i th t h e r e p a y m e n t of t h e loan.
(5) A n y loan obta ined by t h e counci l u n d e r th i s
A c t shal l n o t he t aken in to accoun t for t h e purpose of
ascer ta in ing the l imi t to which t h e counci l m a y borrow
u n d e r t h e Loca l G o v e r n m e n t Ac t , 1919.

7. The counci l m a y levy tol ls and charges in con­

nec t ion wi th traffic across t he br idge ; t h e a m o u n t of t h e
tol ls and charges , a n d t h e m e t h o d of collection shal l be
as prescr ibed.
8. The council shal l , if a n d w h e n r equ i r ed by t h e
Minis ter , supply all accounts , par t icu la rs , a n d o ther
in fo rmat ion a t i ts disposal to enab le h i m to ascer ta in
t h e to ta l a m o u n t to be expended by t h e counci l in
ca r ry ing out t h e provisions of th i s A c t w i th regard to
t h e cons t ruc t ion of t h e br idge , t h e acquis i t ion of land in
connec t ion the rewi th , or a n y o the r m a t t e r r e la t ing
t he re to .

9.     The counci l shall es tabl ish a s ink ing fund for the

purpose of ex t i ngu i sh ing t h e l iabil i ty on t h e loan
w i t h i n t w e n t y years from t h e da te of t h e opening of t he
b r idge for traffic wi th in teres t a t a r a t e n o t exceeding
six per c e n t u m per a n n u m .
  1. Al l moneys received from tolls or charges im­

posed unde r th is A c t shal l he paid in to a special h a n k
accoun t t o be k e p t by t he council , and shall bo appl ied

in t h e first place towards t h e cost of m a i n t a i n i n g and repa i r ing t he br idge a n d the collection of t h e tolls a n d charges , and in t h e n e x t place towards t he in s t a lmen t s necessary to ma in t a in t he s ink ing fund. A n y su rp lus received by the counci l shal l be applied as the Governor m a y direct towards r e p a y m e n t of t he loan or t he cost of

t h e m a i n t e n a n c e and repai r of t h e br idge.
1 1 . (1) W h e n the Governor is satisfied t h a t all

moneys expended b y t h e council upon t h e cons t ruc t ion of t h e br idge , t he acquisi t ion of land in connect ion the rewi th , t he repai r and ma in tenance of the b r idge , t h e costs of collection of t he tolls and charges and t h e in teres t , costs, charges and expenses of the loan a n d of all m a t t e r s incidental to t h e car ry ing out of t he purposes of th is Act , have been fully repaid out of the tolls and charges collected, he shall cause a notification to t h a t effect to be publ ished in t he Gazet te .

(2) Thereupon—•

(a)

any regula t ions made u n d e r th i s Act impos ing tolls and charges shall be r evoked ; and t h e provisions of th is Ac t au thor i s ing t he imposi­ t ion of tolls and charges shal l cease to have effect;

(b)

t h e br idge shall be a n d become a na t iona l work w i th in t h e m e a n i n g of t he Local Governmen t

Act , 1919.
12. (1) The Governor m a y m a k e regula t ions for
a n d w i t h respect t o —
(a) prescr ib ing the a m o u n t s of t he tolls and
charges to be imposed by t h e c o u n c i l ;
(b) t he control , m a n a g e m e n t , ma in t enance , and
protect ion of t h e br idge and its a p p r o a c h e s ;

(c)

the regula t ion , restr ict ion, or suspension of t h e use by the publ ic of t h e br idge and i ts approaches ;

(d)
t he ca r ry ing out t h e provisions of th is Ac t .
(2) The regula t ions m a y impose a pena l ty not
exceeding fifty pounds for any b reach thereof. Any
such pena l ty m a y be recovered in a s u m m a r y m a n n e r
before a s t ipendiary or police mag i s t r a t e or any two
jus t ices in pe t ty sessions. f(3)
(3) The regulations shall—

(i) be published in the Gazette ;

(ii)   take effect from the date of publication or from a later date to be specified in the regu- lations ; and

(hi) be laid before both Houses of Parliament within fourteen sitting days after the publica- tion thereof if Parliament is then in session, and if not, then within fourteen sitting days after the commencement of the next session.

If either House of Parliament passes a reso- lution of which notice has been given at any time within fifteen sitting days after such regulations have been laid before such House disallowing any regulation or part thereof, such regulation or part shall thereupon cease to have effect.
