CaseChat Overview and Summary
The primary legal issues were whether the agreement was made genuinely and freely, whether it contained the necessary minimum terms and conditions, and whether it complied with the procedural requirements outlined in the Fair Work Act 2009. Additionally, the court had to determine if the agreement was in the best interests of the employees and if it promoted workplace harmony.
The Fair Work Commission found that the agreement was made genuinely and freely, contained the necessary minimum terms and conditions, and complied with the procedural requirements. The agreement was deemed to be in the best interests of the employees and was likely to promote workplace harmony. Consequently, the Commission approved the enterprise agreement. The decision was grounded in the understanding that the agreement reflected a balance of interests and was made in good faith.
The final orders of the Commission were that the Geographe Civil Pty Ltd Enterprise Agreement 2014 be approved and registered under the Fair Work Act 2009. This decision was made on the basis that the agreement met all the necessary legal criteria and was in the interests of both the employer and the employees.
