Application for approval of the Genesee & Wyoming Australia Pty Ltd (SA/NT) Infrastructure Maintenance Collective Agreement 2013

[1]An application for approval of an enterprise agreement known as the Genesee & Wyoming Australia Pty Ltd (SA/NT) Infrastructure Maintenance Collective Agreement 2013 (the Agreement) has been made by Genesee & Wyoming Australia Pty Ltd (the employer). The application has been made pursuant to s.185 of the Fair Work Act 2009 (the Act) and is an application for a single-enterprise agreement.

[2] I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act, as are relevant to this application for approval, have been met.

[3] The Australian Rail, Tram & Bus Industry Union (RTBU) has given notice under s.183 of the Act that it wants the Agreement to cover it. As required by s.201(2) of the Act, I note that the Agreement covers the RTBU.

[4] The Agreement is approved. In accordance with s.54(1) of the Act, the Agreement will operate from 26 April 2013. The nominal expiry date of the Agreement is 31 December 2016.
