GENERAL LOAN ACCOUNT (EXPENDITURE

VALIDATION) ACT.

Act No. 28, 1952.

An Act to validate the application of certain moneys from the General Loan Account for the purpose of advances to certain Councils of Local Government Areas towards the cost of construction of certain abattoirs; and to remove doubts as to the validity of certain agreements relating to such advances ; and for purposes connected therewith. [Assented to, 21st October, 1952.]

WHEREAS in terms of the General Loan Account Appropriation Act (No. 2), 1946, the General Loan Account Appropriation Act, 1948, the General Loan

Account Appropriation Act, 1949, and the General Loan Account Appropriation Act, 1950, certain moneys were appropriated from the General Loan Account to be applied in the construction of miscellaneous works in Shires and Municipalities AND WHEREAS certain of the moneys, so appropriated, were applied for the pur­ pose of making advances to certain Councils within the meaning of the Local Government Act, 1919, as amended by subsequent Acts, under the provisions of section five hundred and thirty-nine of the said Local Government Act and in terms of certain agreements entered into by the Minister for Public Works with such Councils in pursuance of that section AND WHEREAS the appropriations as aforesaid were not appropriate to the purpose for which the said moneys were so applied BE it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

1. This Act may be cited as the "General Loan Account (Expenditure Validation) Act, 1952."

2. In this Act unless the context or subject matter otherwise requires "Counci l" has the meaning given thereto in the Local Government Act, 1919, as amended by subsequent Acts.

3. The application from the General Loan Account for the purpose of advances to the Councils of the Cities of Goulburn and Wagga Wagga and the Councils of the Municipalities of Dubbo and Gunnedah towards the cost of construction of Country Killing Centres by those Councils, during the respective financial years set out in the first column of the First Schedule to this Act, of the amounts set out in the second column of that Schedule opposite each such financial year, which said amounts were appropriated for the purpose of construction of miscellaneous works in Shires and Municipalities by the Acts referred to in the third fourth fifth and sixth columns of that Schedule, is hereby validated.

4. The said advances to the respective Councils referred to in section three of this Act shall be deemed to have been made under and in all respects in conformity with the provisions of section five hundred and thirty- nine of the Local Government Act, 1919, as amended by subsequent Acts, and shall be deemed to have been made by the Minister for Public Works to the respective Councils under and in accordance with the provisions of the respective agreements between the said Minister and the said Councils, particulars of which are set out in the Second Schedule to this Act.

The said agreements shall be deemed to comply and always to have complied in all respects with the

provisions of section five hundred and thirty-nine of the

Local Government Act, 1919, as so amended.
