AN ACT to amend the General Insurance Brokers

and Agents Act 1981.

[Assented to 22 November 1983.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the General aSnhaftetitg;?,..

(2) In this Act the General Insurance Brokers ;;Ftigy:,7

and Agents Act 1981 is referred to as the principal

Act.

(3) The principal Act as amended by this Act may be cited as the General Insurance Brokers and Agents Act 1981-1983.

Section 6

amended.

2. Section 6 of the principal Act is amended in subsection (1) by deleting paragraphs (c) and (d) and substituting the following paragraphs

(c)

one, being a person who is conversant with the business and operations of insurers and insurance agents, shall be nominated for appointment by the Min- ister from a panel of names submitted by the Insurance Council of Australia Ltd, a body corporate; and

(d)

one, being a person who is conversant with the business and operations of insurance brokers, shall be nominated for appointment by the Minister from a panel of names submitted by the National Insurance Brokers Association of Australia Ltd, a body corporate. ".

Section 37

repealed.

3.

Section 37 of the principal Act is repealed.

4. The Schedule to the principal Act is

amended

(a) by repealing clauses 1 and 2 and substitut-

ing the following clause-

to submit to him in writing within the period specified in that request a panel of the names of not less than 3 individuals, each of whom is qualified and willing to be appointed to that office.

(2) The Minister may, if he has made a request under subelause (1) of this clause and no panel of names is submitted to him in accordance with the request, appoint to the relevant office of member such person, being a person qualified and willing to be appointed to that office, as he thinks fit. ";

(b)

in clause 3 (2) by deleting "election" and substituting the following-

" submission of a panel of names "; and

(c) in clause 4 by repealing-

(i)

subclause (1) and substituting the

following subclause-

(1) Subject to this Act, each member shall hold office for such period not exceeding 4 years as is specified in the instrument of his appointment, and is eligible for reappointment. "; and

(ii)

subclause (5) and substituting the

following subclause-

"

(5) Notwithstanding the coming into operation of the General Insur- ance Brokers and Agents Amend- ment Act 1983, the person who held the office referred to in section 6 (1) (c) immediately before that coming into operation shall, subject to this Act, continue to hold that office until the expiry of his term of office. ".
