HERE AS it is desirable to extend the Railway from the Gawler as shown in thc plan hcrcinaftcr mcntioncd, and to providc for thc

W Bailway Station to Marlcct Rcscrvc in thc 'l'awn of Gawler,

construction of such cxtension of railway; and for the acquiring of certain lands, also shown in the said plan: And whereas a plan showing the lands proposed to be acquired, which plan is headed

" Plan showing arnended route for Railway from Gander Railway

Station to the Town of Gawler," ancl signed " H. C. Msis, Engineer- in-Chief, 11/9/77," together with the hook of reference thereto, have h e n duly prepared and depositccl in the o6cc of thc Surveyor- General, at Adclaidc-BC it therefore Enacted by the Governor of the Province of South Australia, with the advice and consent of the Legislative Council and House of Assembly of the said Province, in this present Parliament assembled, as follows:

l. This Act may be cited for all purposes as " The Gader Town short title.

2. The Lands Clauses Consolidation Act," No. 6 of 1847; " The Incor~oration.

Railways Clauses Consolidation Act," No. 7 of 1847; " An Act to amend L The Railways Clauses Consolidation Act, Xo. 7 of 1847,' " being thc Act, No. 6 of 1858, so far as the same are severdly appli- cable to this Act; The Adelaide and Gawler Town Railway .Act," No. 18 of 1854.: and the Railway Commissioner's Act," No. 11 of 1859; shall be incorporated herewith, and this Act and the said

3. The Commissioner of Railways may enter upon and use the roads and streets, and may enter upon, use, take, and acquire the lands delineated and referred to in the plan showing the line of the said railway and the lards proposed to be so taken, signed a H. C. Mais, ~n~fneer-in-chief, li/9/77," and deepositcd in the 'office of the Surveyor-General, at Adelaide, as aforesaid, or so much thereof as shall be or be deemed necessary, and may make and maintain upon

the lands so taken or acquired the railway and bridge shown upon the plan, and also such buildings, erections, works, and conveniences connected therewith as shall be or be cleernecl necessary for such pur- poses, or any of thein.

Power of Commio-

4. The said Commissioner shall have ancl exercise the like powers and authorities with reference to the undertaking hereby authorized, as arc conferred upon him by the said Act No. 11 of 1839, in respect to the undertakings therein mentioned: And for the purposes of this Act and for carrying out the undertaking l~erebp authorized, the Cornmissioncr shall be deemed to be 'The Pzomotcrs of the Under- taking " mentioned in the said Act No. 6 of 1847, and shall and may have and exercise in relation to the uilclertaking hereby autho- rized, all the powers and authorities by such Act vested in The Promoters of the Undertaking: " And ;or the purposes of this Act, and for carrying out the undertaking hereby authorized, the said Commissioner shall be dcemed to be *b Thc Company " mentioned in thc said Act No. 7 of 1847, and s l ~ d l and may havc anci exercise in relation to such undertaking all tbc powers ancl authorities by such Act vested in the Company.

5. The gauge of

the said railway shall be five feet three inches,

and the rails to be used in the construction thereof shall be of iron,

and of the weight of

not less than forty pounds to the yard.

6. The said Commissior,er, in the construction of the railmay by this Act authorized to be made, may make the same from the Gawler

Railway Station to Market Reserve in the Town of Gawler, ac-

cording to the route delineated in the said plan, and may carry the

same on the level along or across (ss the case may require) the several roads lettered on the plans herei~before mentioned as fol-

lows, that is to say-A,

7. The said Commissioner shall, with respect to all roads shown upon the said plans, have all the rights, authorities, and powers of

Commissioners of Roads, under an Act, No. l 7 of 1852, "For the making and improving of Roads in South Australia," and the Roads Amendment Act, 1863."

Exemption from local

rates.

8. The lands hereby authorized to Fe taken and acquired, and the erections by this Act authorized to be constructed shall be, and are hereby declared to be, exempt from sewers, highway, municipal, police, improvement, and all other local rates and taxes.

9. The powers hereby vested in the said Commissioner for the Limiting powers of

the expiration of five years from the passing of this Act.
