THE GATTON SOHOOL OF ARTS AOT OF 1906. Parish and Town of Gatton, and to apply the Moneys so raised towards the Improve- ment of the said Land, and for other incidental purposes. [ASSENTED TO 14TH DECEMBER, 1906.J lllTHEREAS by a deed of grant dated the twenty-ninth Preamble. \' \' day of November, one thousand nine hundred and ~ ix, and numbered ~ ) 3: W4, all that parcel of land in the State of Queensland, containing one rood and twenty perches, situated in the county of Churchill, parish and town of' Gatton, being allotment number sixteen of section seventeen (hereinafter referred to as "the said land "), and more particularly described in the said deed of grant, WRS granted to Richard J ames, William Alexander Wellstead, and Edward Whittle, all of Gatton aforesaid, upon trust for a School of Arts, and for no ot,her purposes whatsoever: And whereas the said land is now vested in the said Richard James, \JVTilliam Alexander Wellstead, and Edward Whittle as such Trustees as aforesaid: And whereas the said Trustees are desirous of mortgaging the said land to an amount not exceeding three hundred pounds, and applying the moneys so raised towards the erection on the said land of a building to be used for the purposes of the said trust: And whereas it is anticipated that the revenue to be derived from so much of the said building as is not immediately used as a school of arts will he sufficient to provide the interest due from time to time in respect of

No. 27, 1906. the said mortgage moneys and to repay the said mortgage moneys at the due date thereof: And whereas it is. desirable that the aforesaid powers should be conferred upon the said Trustees subject to the conditions by this, Act prescribEd: Be it therefore enacted by the King's. Most l<:xcellent Majesty, by and with the advice and con- scnt of the Legislative Oouncil and Legislative Assembly of Queensland in Parliament assembled, and by the' authority of the same, as follows :- Short title. 1. This Act may be cited as "The Gatton School of Arts Act 0/1906." Interpreta- tion. 2. In this Act the term "the Trustees" means and: includes the said Richard James, William Alexa;nder- Wellstead, and Edward Whittle, and their succeSsors ill! office who for the time being are Trustees of the said land., Trustees may 3. (1.) The Trustees may mortgage the said land for- mortgage. any sum or sums of money not exceeding in the wholc- three hundred pounds, and in such manner as may be' directed by the committee of management of the Gatton School of Arts for the time being, testified in writing under- the hands of the members of the said committee or of a majority of them. Mortgagemay (2.) Every such mortgage may contain a power of ~ £ ~ ~ : ~ ~ er sal~ by ~ he mortgagee, his. executors, administ~at~rs, or- aSSIgns, m case of default m payment of any prmCIpal or- interest moneys secured by such mortgage, or of breach of any of the conditions therein contained. Application 4. All moneys raised by any such mortgage shall be ooff mproorctegeadgse, expended in the following order, so far as the same extend~ &0. that is to say, in payment of- (a) The reasonable expenses of and attending such mortgage; (b) The cost of the erection of a building to be called the Gatton School of Arts on the said land; (c) The cost of all necessary fittings and furniture for the said building. Trustees' receipts to be a good discharge. 5. The receipts in writing of the Trustees for any moneys paid or advanced to them in respect of any such mortgage shall be a good and sufficient discharge for such moneys to the person or per~ ons paying or advancing the same, and he or they shall not be required to see to the application nor be affected by the mis-application or non-application thereof.
