2 Gateway Bridge Agreement Amendment No. 2, 1993 ˙ Short title 1. This order in council may be cited as the Gateway Bridge Agreement Amendment Order 1993 . ˙ Approval of agreement to vary the Agreement 2. The agreement, set out in the Schedule, between the Minister and the Company to vary the Agreement is approved.

3 Gateway Bridge Agreement Amendment No. 2, 1993 ¡ SCHEDULE VARYING AGREEMENT section 2 THIS AGREEMENT is made the eleventh day of November 1992 between the © State of Queensland (hereinafter called “ the State ” ) and The Gateway Bridge Company Limited (ACN 010 127 303) a company incorporated in Australia and having its registered office at Administration Building, Administration Road, Murarrie, Brisbane in the said State (hereinafter referred to as “ the Company ” ). Recitals A. By an Agreement made on the 5th day of June 1980 between the Minister for Local Government and Main Roads, the Minister for the time being charged with the administration of the GatewayBridgeAgreement Act 1980 (hereinafter called “ the Act ” ) for and on behalf of the State of Queensland (hereinafter called “ the Minister ” ) and the Company substantially in accordance with the form contained in the Schedule to the Gateway Bridge Agreement Act 1980, the State of the Company agreed upon certain matters set out therein. B. It is provided by section 5 of the Actthat the Agreement may be varied pursuant to agreement between the Minister and the Company with the approval of the Governor in Council by Order in Council. C. The Minister and the Company have reached agreement to vary the Agreement subject to the approval of the Governor in Council.

4 Gateway Bridge Agreement Amendment No. 2, 1993 IT IS AGREED that the Agreement be varied as follows:- (1) Clause 2(1) of Part I is amended by deleting the definition of “ Commissioner ” and inserting the following definition of “ Commissioner ” :- “ ‘ Commissioner ’ means the Director-General, Department of Transport. ” (2) Clause 2 of Part V is amended by adding to the end of subclause (2) the words “ unless the Owner has obtained the prior written consent of the Commissioner. ”.
