GAS TRANSMISSION AMENDMENT REGULATIONS 1997

Made by the Governor in Executive Council.

Citation

1.      These regulations may be cited as the Gas Transmission Amendment

Regulations 1997.

Principal regulations

2.      In these regulations the Gas Transmission Regulations 1994* are referred

to as the principal regulations.

Regulation 90 amended

3.      Regulation 90 (1) (h) of the principal regulations is amended C

(a) by inserting after “200,” the following C

“ 201, ”; and

(b) by deleting “207,”.

Regulation 200 amended

4.      Regulation 200 of the principal regulations is amended C

(a)

by inserting before the definition of “category A gas” the following definition C

“broadest specification”, for a category of gas, means the gas quality specification for that category of gas set out in Schedule 4A, and includes each component of that specification;

(b) in the definition of “extractable LPG” by deleting “prescribed” and substituting the following C

“ operating ”;

(c) by inserting after the definition of “LPG” the following definition C

“operating specification”, for a category of gas, means C

(a)

the gas quality specification for that category of gas determined from time to time under regulation 201 (1); or

(b)

if a gas quality specification for that category of gas has not been determined under regulation 201 (1), the gas quality specification for that category of gas set out in Schedule 4,

and includes each component of a specification referred to

in paragraph (a) or (b);

”;

(d) in the definition of “out-of-specification gas” by deleting “prescribed” and substituting the following C

“ operating ”; and

(e) by deleting the definition of “prescribed specification”.

Regulation 201 repealed and a regulation substituted

5.      Regulation 201 of the principal regulations is repealed and the following

regulation is substituted C

Determination of gas quality specifications

201. (1) Subject to regulation 202, the corporation may, with the

approval of the Coordinator C

(a) determine gas quality specifications for category A gas, category B gas, and category C gas; or
(b) amend any determination under paragraph (a),

and a reference in these regulations to a gas quality specification determined under this subregulation includes any amendment made to the relevant determination under paragraph (b).

Approval is not to be given for the purposes of subregulation (1) unless the Coordinator has first C

(a) given notice of the proposed determination or amendment to the corporation in its capacity as the distribution business and to every shipper, and has caused a copy of that notice to be published in the Gazette; and
(b) given interested persons a reasonable opportunity to make representations in relation to the proposed determination or amendment.

Subject to subregulation (5), a gas quality specification for a category of gas determined under subregulation (1) is not to include a component that is less stringent than the corresponding component of the broadest specification for that category of gas.

(3)  

The corporation may, with the approval of the Coordinator, include in the gas quality specification for a category of gas determined under subregulation (1) one or more components that are expressed to apply C

(4)

(a) in limited circumstances described in the specification; and

(b)

for a limited period ascertainable in accordance with the specification.

(5) A component referred to in subregulation (4) may be less stringent than the corresponding component of the broadest specification for the relevant category of gas.

The corporation, upon request, is to make available to any person

a copy of any current or superseded gas quality specification determined
under subregulation (1).

Regulation 202 repealed and a regulation substituted

6.      Regulation 202 of the principal regulations is repealed and the following

regulation is substituted C

Gas quality specifications for outlet points must comply with Gas
Standards Act 1972

202. A gas quality specification for category B gas or category C gas determined under regulation 201 (1) is not to include a component that is less stringent than any corresponding component of a specification prescribed under the Gas Standards Act 1972 for natural gas distributed to a consumer through gas mains and service lines.

Regulations 203, 204, 205 and 207 repealed

7.      Regulations 203, 204, 205 and 207 of the principal regulations are repealed.

Regulation 208 amended

8.      Regulation 208 of the principal regulations is amended C

(a) by deleting “203,”;
(b) by inserting after “regulation 211” the following C

“ or 212 ”; and

(c) by deleting “prescribed” in both places where it occurs and substituting the following C

“ operating ”.

Regulation 210 amended

9.      Regulation 210 of the principal regulations is amended by inserting after

“regulation 194 (6a),” the following C

and to any agreement under regulation 211 or 212, ”.

Regulation 211 amended

10.      Regulation 211 (3) of the principal regulations is repealed and the

following subregulation is substituted C

The corporation may impose a surcharge or penalty upon a

shipper for accepting out-of-specification gas on the basis of the quality of
the gas delivered by the shipper.

Regulation 260 amended

11.      Regulation 260 (4) of the principal regulations is amended by deleting “gas

quality specifications which differ from those prescribed under Division 8.2” and

substituting the following C

a gas quality specification for a category of gas which differs from the operating specification (as defined in regulation 200) for that category of gas

Regulation 262 amended

12. (1) Regulation 262 (2) of the principal regulations is amended by

deleting “a prescribed specification under Division 8.2.” and substituting the

following C

an operating specification (as defined in regulation 200) ”.
(2) Regulation 262 (3) of the principal regulations is amended by deleting

“specification under Division 8.2.” and substituting the following C

component or components of the relevant operating specification (as

defined in regulation 200).

Schedule 4 amended

13.      Schedule 4 to the principal regulations is amended C

(a) by deleting “prescribed” and substituting the following C

“ operating ”;

(b) by inserting before “specifications” the following C

“ gas quality ”; and

(c) in the first column of the Table by inserting above “Maximum carbon dioxide (mol %)” the following heading C

“ Component ”.
