Explanatory note

The object of this Regulation is to amend the Gas Supply Regulation 1991 so as to allow certain persons to continue to distribute and supply natural gas and liquefied petroleum gas pending the determination of their applications for the appropriate authorisation or licence.

This Regulation is made under the Gas Supply Act 1996, including section 83 (the general regulation making power) and clause 1 of Schedule 2 (the power to make regulations of a savings or transitional nature).

1 Name of Regulation

This Regulation is the Gas Supply Amendment (Transitional
Exemptions) Regulation 1996.

2     Amendment of Gas Supply Regulation 1991

The Gas Supply Regulation 1991 is amended as set out in

Schedule 1 .

(Clause 2)

Clause 53

Insert after clause 52:

53 Transitional exemptions fer certain suppliers and

distributors

(1) This clause applies to any person who, immediately before I2 July 1996, was an exempt supplier or distributor of gas under section 4 (2) of the old Act.
(2) A person to whom this clause applies is exempt from the requirements of sections 5 (Prohibition of unauthorised gas reticulation and gas supply) and 34 (Prohibition of unlicensed distribution of LPG and other gases) of the new Act if:
(a) before 12 July 1996, the person had applied for an authorisation under the old Act, or
(b) on or after 12 July 1996, the person applies for an authorisation or licence, as the case requires, under the new Act.
(3) In this clause:
the new Act means the Gas Supply Act 1996.
the old Act means the Gas Industry Restructuring Act
1986.
(4) This clause:
(a) is taken to have commenced on 12 July 1996, and
(b) ceases to have effect on 1 April 1997.
