Gas Supply Amendment (System

User) Regulation 1997

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Gas Supply Act 1996.

Explanatory note

The object of this Regulation is to declare all gas users to be system users, for the purposes of the Gas Supply Act 1996, on and from 1 July 1999. The effect this declaration is to give all gas users an entitlement to be granted access to those gas distribution systems that are declared to be open to third party access, so enabling all gas users to obtain gas supplies from the supplier of their choice.

This Regulation is made under the Gas Supply Act 1996, including section 83 (the general regulation making power) and the definition of system user in the Dictionary to that Act.

1 Name of Regulation

This Regulation is the Gas Supply Amendment (System User)
Regulation 1997.

2     Amendment of Gas Supply Regulation 1991

The Gas Supply Regulation I991 is amended as set out in

Schedule 1.

Schedule 1 Amendments

(Clause 2)

Clause 6 Definition of system user

Insert after clause 6 (3A) the following subclause:

(3B) On and from 1 July 1999, all persons to whom gas is supplied are declared to be system users for the purposes of the definition of system user in the Dictionary to the Act.
